An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located 822 5th Avenue (parcel # 019-018-016) from GC (General Commercial)

Zoning District to RMF1 (Residential Multi-family 1) Zoning District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Department is hereby

amended by changing the aforementioned property from RMF2 (Residential

Multi-family 2) Zoning District to RMF1 (Residential Multi-family 1) Zoning

District:



Parcel One:

All that tract or parcel of land situate, lying and being in the State of

Georgia, County of Muscogee and City of Columbus, and being part of NORTH

ONE-HALF (1/2) of CITY LOT NUMBERED FIVE HUNDRED EIGHTY (580), beginning on the

east side of Fifth Avenue at a point three hundred six feet and nine inches

(306?9?) south from the south line of Ninth Street, City of Columbus, County of

Muscogee; thence south 37 feet along the east side of Fifth Avenue; thence

north a distance of 37 feet; thence west one hundred forty-nine feet and eight

inches (149? 8?) to point of beginning; being part of the north one-half (1/2)

of lands conveyed to T.A. Marcrum by deed recorded in Deed Book MM, Page 313,

of Muscogee County records. This is the identical property conveyed to Spencer

James by J. B. Robertson by warranty deed dated April 10, 1947, and recorded

May 7, 1947, in Muscogee County, Georgia. Located thereon is house numbered

822 Fifth Avenue, according to the present system of numbering houses in the

City of Columbus, Georgia.

This is the same property that J.B. Robertson conveyed to spencer James and

Luella Reese James by deed dated April 10, 1947, recorded in Deed Book 261,

page 86, in the office of the Clerk of the Superior Court of Muscogee County,

Georgia. Luella Reese James died on May 23, 1962. Her Will, dated June 17,

1952, was Probated in Solemn Form by the Probate Court of Muscogee County,

Georgia, on June 30, 1960 and Letters Testamentary were issued to Spencer

James, as Executor. The Will of the deceased left her entire estate to her

husband, Spencer James, although no formal Deed of Assent was ever done. See

Wills Book L, Page 267 and Minutes Book ZZ, Page 297, Muscogee Probate Court

records.



The above-described property is being rezoned with the following conditions:



1. Minimum lot size shall not be less than 5662 square feet in size or .13

acres.
