SUBJECT: Property Acquisition- 1133 35th Street



INITIATED BY: Department of Community Reinvestment/Department of Engineering







Recommendation: Approval is requested to purchase property at 1133 35th Street

a/k/a Tax Map Parcel 030 018 004 for a sewer abandonment project in Columbus,

Muscogee County, Georgia (see attached map).



Background: An investigation was conducted, after the appearance of Mr. Robert

E. Goolsby at Council in October 2010. A sewer of undetermined origin

currently runs under the residential structure at 1133 35th Street. The origin

and flow type has not been determined due to the current condition of the pipe

and inability to locate the upper end of the pipe, but is believed to drain in

a low area on adjoining property. The residential structure has sustained

substantial damage. As part of the investigation, it was determined that a

portion of the pipe on private property was repaired as part of a cave in. The

project scope will be determined base on further investigations after taking

possession of the property and will at a minimum consist of abandonment of the

pipe under the structure and relocation if necessary. The structure will be

evaluated for the feasibility of repair or demolition.



Analysis: Based on an independent appraisal and through good faith

negotiations, the City and owner have agreed upon a fair and equitable price of

$95,000 for the property. Upon completion of the project, the City will

advertise and sale said property.



Financial Considerations: The value of the property has been determined to be

$95,000 and $5,000 demolition. The seller has agreed to accept payment from

the City for the value of the property. The City will pay all closing cost

associated with the purchase. Funds for the purchase of the property will be

made from the CIP-General Fund Supported Property Acquisition Account. If it

is determined the structure can be repaired and it is feasible, then additional

funds will be required for the repairs.



Projected Annual Fiscal Impact Statement: There will be no annual impacts.



Legal Considerations: The purchase of property requires Council approval. The

City Attorney has reviewed this matter and recommends purchase of the property.



Recommendations/ Actions: Approve a resolution for the purchase of the

property at 1133 35th Street a/k/a Tax Map Parcel 030 018 004 for a sewer

abandonment project in Columbus, Muscogee County, Georgia.

A RESOLUTION AUTHORIZING THE PURCHASE OF 1133 35TH STREET A/K/A/ 030 018 004

FOR A SEWER REPLACEMENT PROJECT IN COLUMBUS, MUSCOGEE COUNTY, GEORGIA.

WHEREAS, the property located at 1133 35th Street has sustained damaged to the

structure and land due to a sewer line that runs under the residential

structure and through the property; and,

WHEREAS, it has been determined through an appraisal the price of $95,000 is

fair and equitable; and,

WHEREAS, upon completion of the project to abandon the existing sewer line and

repair or demolish the residential structure, the City will advertise and sale

said property; and,

WHEREAS, it is in the best interest of the Consolidated Government of Columbus,

Georgia to purchase the property; and,

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to purchase 1133 35th Street

aka Tax Map Parcel 030 018 004 for the purchase price of $95,000 for a Sewer

Replacement Project and $5000 for demolition. The purchase of the property

will be funded from CIP-General Fund Supported Property Acquisition Account.

Upon completion of the project the City will advertise and sale said property.
