AN ORDINANCE
NO.
An Ordinance amending the Zoning Atlas of the Consolidated Government
of Columbus, Georgia; this amendment changes certain boundaries of a district
located on the west side of South Lumpkin Road, north of Rigdon Park, from LMI
(Light Manufacturing / Industrial) District to RMF2 (Residential Multi-Family
2) and GC (General Commercial) District.
THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:
That the Zoning Atlas on file with the Planning Department be, and
the same is hereby amended by changing the following described property from
LMI (Light Manufacturing / Industrial) District to RMF2 (Residential
Multi-Family 2) District:
All that lot, tract and parcel of land lying and being Part of Land Lots 9 and
10, 7th District, Columbus, Muscogee County, Georgia, and being more
particularly described as follows:

To reach the Point of Beginning of the property herein conveyed, commence at
the northwest corner of the intersection of South Lumpkin Road and Hawthorne
Drive and from said point running thence North 01 degree 50 minutes 56 seconds
East along the western boundary of South Lumpkin Road a distance of 140.44 feel
to an iron stake which marks the Point of Beginning of the property herein
conveyed; and from said iron stake running thence South 87 degrees 06 minutes
42 seconds West a distance of 2,530.52 feet to an iron stake; running thence
North 02 degrees 48 minutes 30 seconds West a distance of 700 feet to an iron
stake; running thence North 40 degrees 48 minutes 37 seconds West a distance of
520.0 feet to an iron stake; running thence North 45 degrees 00 minutes 00
seconds East a distance of 629 feet, more or less, to a point in the centerline
of Bull Creek; running thence in a southeasterly, easterly, and northeasterly
direction along the centerline of said Bull Creek a distance of 29.83 feet,
more or less, to a point where said centerline intersects the western boundary
of Victory Drive; and from said point running thence South 44 degrees 03
minutes 44 seconds East along the western margin of Victory Drive a distance of
698.0 feet, more or less, to an iron stake located on said western margin of
Victory Drive; running thence South 87 degrees 11 minutes 11 seconds West a
distance of 186.18 feet to an iron stake; running thence South 18 degrees 15
minutes 34 seconds East a distance of 209.0 feet to an iron stake; running
thence North 86 degrees 50 minutes 38 seconds East a distance of 201.48 feet to
an iron stake on the westerly margin of South Lumpkin Road; running thence

said westerly margin of South Lumpkin Road along a curve to the right having a

distance of 170.0 feet to an iron stake located along the westerly margin of
South Lumpkin Road; thence running along the westerly margin of South Lumpkin
Road South 01 degree 50 minutes 56 seconds West a distance of 336.52 feet to
the Point of Beginning.
Said property is shown upon a map or plat thereof entitled "Survey of Part of
the Ann Cooper Whitesel Property, Lying in Land Lots 9 &: 10, 7th District,
Columbus. Muscogee County. Georgia." dated November 26, 1997, and prepared by
Moon, Meeks, Mason &: Vinson, Inc., Civil Engineers, Columbus,
Georgia, and recorded in Plat Book 155, Folio 109, in the Office of the Clerk
of the Superior Court of Muscogee County, Georgia.
LESS AND EXCEPT (as to Parcel One):
1) Those certain lots, tracts, and parcels of land known and designated
as Lot 100, 1.00 Ac. and Lot 101, 1.00 Ac., as shown on that certain map or
plat entitled "Replat of Part of Land Lot 9, 7th District, Columbus, Muscogee
County, Georgia," dated January 14, 2001, prepared by Moon, Meeks, Mason &
Vinson, Inc., Civil Engineers, and recorded in Plat Book 145, page 62, in the
Office of the Clerk of the Superior Court of Muscogee County, Georgia.
2) Those certain lots, tracts, and parcels of land designated as 1,2,
and 3 as shown on that certain map or plat entitled "Survey for Mr. John
Rigdon, Part of Land Lot 9, 7th District. Columbus, Muscogee County, Georgia,"
dated June 22, 1959, prepared by A. B. Moon, Jr., C.E., and recorded in Plat
Book 22, page 33, in the Office of the Clerk of the Superior Court of Muscogee
County, Georgia.
3) That certain triangular piece of land described in that certain Lease
of Unimproved Real Estate
between Heath Cooper Rigdon and Thomas J. Mitchell, dated December
12, 1974, and recorded in Deed
Book 1530, page 269, in the Office of the Clerk of the Superior Court
of Muscogee County, Georgia, to
which Lease reference is made for the particular location and
dimensions of said triangular piece of
land.

All that lot, tract and parcel of land lying and being Port of Land Lots 65 and
66, Coweta Reserve, and Land Lot 10, 7th District, Columbus, Muscogee County,
Georgia, and being 88.5 acres, more or less, and being more particularly
described as follows:

155, Folio 109, in the Office of the Clerk of the Superior Court of Muscogee
County, Georgia.
Said property is shown upon a map or plat thereof entitled "Survey of Part of
the Ann Cooper Whitesel Property, Lying in Land Lots 65 & 66, Coweta Reserve,
and Land Lot 10, 7th District, Columbus. Muscogee County, Georgia, dated July
20, 1998, and prepared by William A. White, Surveyor, Midland, Georgia, and
recorded in Plat Book 155, folio 110, in the Office of the Clerk of the
Superior Court of Muscogee County, Georgia.
That the Zoning Atlas on file with the Planning Department be, and the
same is hereby amended by changing the following described property from LMI
(Light Manufacturing / Industrial) District to GC (General Commercial) District:
Commencing at a point marking the intersection of the northern right-of-way of
Hawthorne Drive and the western right-of-way of South Lumpkin Road; thence,
along the western right-of-way of South Lumpkin Road, North 01 degree 50
minutes 56 seconds East for a distance of 140.44 feet to a point; thence,
leaving said right-of-way, South 87 degrees 06 minutes 42 seconds West for a
distance of 330 feet to a point, said point being the true point of beginning;
thence South 87 degrees 06 minutes 42 seconds West for a distance of 560 feet
to a point; thence North 00 degrees West for a distance of 130 feet to a point;
thence North 73 degrees East for a distance of 120 feet to a point; thence
North 67 degrees East for a distance of 60 feet to a point; thence North 60
degrees East for a distance of 100 feet to a point; thence North 61 degrees
East for a distance of 150 feet to a point; thence North 74 degrees East a
distance of 90 feet to a point; thence South 81 degrees East for a distance of
90 feet to a point; thence South 01 degree East for a distance of 290 feet to
the point of beginning.
The above-described property is being rezoned with the following conditions:
The entrance/exit driveway shall include separate twelve (12) feet wide left
and right turn lanes having a minimum length of one hundred (100) feet at its
intersection with South Lumpkin Road.
The existing center left turn lane of South Lumpkin Road shall be re-striped to
provide for a northbound exclusive left turn lane into the development entrance.
A southbound twelve (12) feet wide turn lane shall be constructed to access the
entrance roadway of the development.
A traffic signal using mast arm strain poles shall be constructed on South
Lumpkin Road at the entrance roadway with the traffic signal design being
approved by the City Traffic Engineer. Said traffic signal design shall
include fiber optic interconnect cable between this new signal and the existing
signal located at the intersection of South Lumpkin Road and Avondale Drive.
Rosemary Lane shall be extended from the north curb line of Hawthorne Drive
north to the property line as an emergency entrance/exit. Said emergency
entrance/exit shall be secured and not open to daily traffic.
