SUBJECT: Forfeiture Account (Drug Seizure Account)
INITIATED BY: Muscogee County Marshal's Office

Recommendation: Approval is requested that Council with the blessing of the
Mayor support and approve the Muscogee County Marshal's Office to have a
Forfeiture Account (Drug Seizure Account). If approved all funds seized by the
Marshal's Office will be placed in said, account to be used accordingly with
the state of Georgia, Forfeiture Law 16-13-49.
Background: All money and currency which is forfeited under the Georgia
controlled Substance Act (including money and currency from forfeited and
condemned property), which vests in and which is paid into the county treasury
as county funds shall be released from the county treasury and shall be
administered to the Muscogee County Marshal designated for use by the members
of his respective agency. This will be done in accordance with the state of
Georgia, Forfeiture Law 16-13-49.
Analysis: In an effort to continuing training the office of the Marshal's
Office to fight crime and reduce criminal activity in Muscogee County,
Columbus, Georgia, said money and currency and forfeited and condemned property
will be used. Said separate account of the Muscogee County Marshal's Office
shall be used for non-budgeted drug investigative costs, and these funds shall
supplement any funds budgeted for such purposes.
Financial Considerations: None
Projected Annual Fiscal Impact Statement: The City will not incur any
additional cost, however will benefit due to quarterly service charges.
Legal Considerations: The resolution requires Council approval.
Recommendations/ Actions: Approval is requested for the said Forfeiture
Account (Drug Seizure Account).
