SUBJECT: Zenos Dr, Dirk Way, Upland Way Street Closings
INITIATED BY: Engineering Department
Recommendation: Approval is requested to execute a Quit Claim to Tiger
Creek Development in order to construct Pinewood Subdivision, which at time of
completion, the new streets and rights-of-way will be deeded to the City.
Background: Tiger Creek Development is developing a new subdivision
along properties that adjoin street segments of Zenos Drive, Dirk Way and
Upland Way. the new subdivision layout does not coincide with the proposed
street developments. Therefore it is in the City's interest to 1) Delete these
streets segments from public streets 2) Quit Claim street segments of Zenos
Drive, Dirk Way and Upland Way in exchange for acceptance of new streets and
right-of-ways. An Ordinance was approved on January 18, 2007, to delete these
streets segments from public streets. 2007.
Analysis: This development will basically swap existing plated rights-of-way
for new street rights-of-way.
Financial Considerations: There is no expense to the City.
Legal Considerations: These actions requires council approval
Recommendations/ Actions: Authorize the City Manager to execute a Quit Claim to
Tiger Creek Development in order to construct Pinewood Subdivision, which at
time of completion, the new streets and rights-of-way will be deeded to the
City.
