SUBJECT: Temporary and Limited Multiple Purpose Easement Agreement



INITIATED BY: Felton G. Grant, Right of Way Acquisition Coordinator







Recommendation: Approval is requested to execute a "Temporary and Limited

Purpose Easement Agreement" with The Medical Center Hospital Authority.



Background: A portion of the abandon rail line that runs along 18th Street to

10th Avenue has been requested for a temporary use by the Medical Center for

the purpose of parking. The City has no immediate plans of using this section

of the rail line as the Rails to Trails. This project has been moved to

utilize the existing intersections and traffic signals at Linwood Boulevard and

10th Street. Allowing this temporary use will accommodate the Medical

Center's plans for future expansions in this area.



Analysis: The Medical Center Hospital Authority has requested the use of said

property and understands it is a temporary use and can be called off of the

property with a 90 day notice. The City has no immediate use of said property

at this time. There will be no permanent structures allowed.



Financial Considerations: There is no cost to the City. The Medical Center

will pay for the legal work that was required.



Legal Considerations: The City Attorney has no issues with this matter.



Recommendations/ Actions: Approve the resolution authorizing the City Manager

to execute the "Temporary and Limited Multiple Easement Agreement"





















A RESOLUTION

A RESOLUTION AUTHORIZING THE EXECUTION OF A TEMPORARY AND LIMITED MULTIPLE

PURPOSE EASEMENT AGREEMENT WITH THE MEDICAL CENTER HOSPITAL AUTHORITY.

WHEREAS, the Medical Center Hospital Authority, a Georgia nonprofit entity has

requested the use of the City owned old rail line that is adjacent to the

Hospital property as shown on the attached plat; and,

WHEREAS, the City has no need for said property, at this time, and the attached

agreement allows that the property can become null and void with a 90 day

written notice; and,

WHEREAS, the Medical Center Hospital Authority accepts the expense of the

legal action to execute said agreement.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to execute a Temporary and

Limited Multiple Purpose Easement Agreement with The Medical Center Hospital

Authority, a Georgia nonprofit entity.
