SUBJECT: Quit Claim - Lynch Road
INITIATED BY: Community Reinvestment
Recommendation: Approval is requested for the deletion of a segment of a
public street on Lynch Road and authorizing the disposal of said street located
at 7716 Lynch Road a/k/a Tax Map 127 001 105 by Quit Claim Deed to Doug and
Jeannie Jefcoat in Columbus, Muscogee County, Georgia (see attachments).
Deletion of the segment of public street was approved by ordinance on April 24,
2007. This request is to execute the Quit Claim Deed.
Background: Lynch Road was segmented by the construction of the
Manchester Expressway in the early 1960's. The northern segment runs from Warm
Springs Road south to a permanent dead end at the north right-of-way line of
the Manchester Expressway as indicated on the attached drawing. There is no
longer a public need for this section of the road segment. Doug and Jeannie
Jefcoat have requested that the city quit claim our rights to the road segment
of Lynch Road from their north property line south the Manchester Expressway
north right-of-way line located at 7716 Lynch Road a/k/a Tax Map 127 001 105 .
The quit claim to the Jefcoat's will return the property back to the tax
rolls. The Jefcoat's have contacted the other adjoining property owners they
have agreed to quit claim their rights to said road segment.
Analysis: Traffic Engineering installed Red Diamond signs to indicate the end
of this road segment just south of the Jefcoat driveway several years ago in an
attempt to stop dumping and to stop vehicles from driving onto Manchester
Expressway. The City has not maintained the area since the closure of the
road. Mr. Jeffcoat has committed to cleaning up the area and maintaining the
closed area. Over the years there has been consideration of a new Manchester
Expressway interchange for Lynch Road, but there are no plans at this time. It
is recommended that should this road segment be quit claimed to the Jefcoat's
that a Reversionary Clause be included to return said property back to the City
should we need it again for future roadway/interchange improvements. The
attached Resolution requests approval for the Quit Claim Deed to be filed in
the Clerk of Superior Court.
Financial Considerations: There will be no financial impact to the City.
Legal Considerations: Council must approve the execution of a Quit Claim Deed.
Recommendations/ Actions: Approve the attached Resolution declaring the deleted
segment of Lynch Road as surplus and authorizing an executed Quit Claim Deed to
Doug and Jeannie Jefcoat.

QUITCLAIM DEED

THIS INDENTURE made and entered into this _____ day of ___________,
2007, between COLUMBUS, GEORGIA, a consolidated city-county government under
the laws of the State of Georgia, hereinafter referred to as ?Grantor?, and
JEANNE KILGORE JEFCOAT and DOUGLAS MERRITT JEFCOAT, individual residents of the
State of Georgia, hereinafter collectively referred to as ?Grantee? (the words
?Grantor? and ?Grantee? to include their respective successors and assigns
where the context requires or permits).
W I T N E S S E T H T H A T:
Grantor, for and in consideration of one dollar ($1.00) and other
valuable consideration, in hand paid at and before the sealing and delivery of
these presents, the receipt of which is hereby acknowledged, has released,
remised, quitclaimed and conveyed, and does by these presents release, remise,
quitclaim and convey, unto Grantee and conveys any rights retained by Grantor
in and to the following described real estate, to-wit:
All that lot, tract or parcel of land situate, lying and being in Land Lots 97
and 128, 9th District, Columbus, Muscogee County, Georgia and being more
particularly described as follows:
Commence at an iron stake located at the intersection of the westerly right of
way line of Lynch Road and the northerly right of way line of Manchester
Expressway, said iron stake being the POINT OF BEGINNING. Thence run North 03?
33?35? West a distance of 769.12 feet to an iron stake; thence run North 86?
26?25? East a distance of 60.0 feet to an iron stake; thence run South 03?
33?35? East a distance of 741.22 feet to an iron stake; thence run South 61?
30?20? West a distance of 66.17 feet to an iron stake, said iron stake being
the POINT OF BEGINNING.
Said tract consists of approximately 1.04 acres as shown on that certain map or
plat entitled ?Right-of Way Survey, Part of Lynch Road, Lying in Land Lots 97 &
128, 9th District, Columbus, Muscogee County, Georgia,? as prepared by A.B.
Moon, Jr., R.LS. No. 782 of Moon, Meeks, Mason & Vinson, Inc., dated March 6,
2007, and which is attached hereto as Exhibit A and incorporated herein by this
reference.
This conveyance is hereby made subject to all valid and enforceable restrictive
covenants and easements of record applicable thereto; and subject, also, to all
valid and enforceable zoning ordinances and regulations applicable thereto so
long as said ordinances and regulations remain in full force and effect.
SUBJECT HOWEVER, THAT IN THE EVENT THE GRANTOR OR ANY OTHER FEDERAL, STATE, OR
LOCAL GOVERNMENT AGENCY SHALL REQUIRE THE PROPERTY HEREIN CONVEYED FOR THE
ADDITION OR EXPANSION OF ANY ROAD OR BRIDGE, THE HEREIN DESCRIBED PROPERTY
SHALL REVERT TO GRANTOR.
The execution of this deed was authorized by resolution of the Council of
Columbus, Georgia adopted on ________________, 2007.

A RESOLUTION AUTHORIZING TO EXECUTE A QUIT CLAIM DEED FOR THE PORTION OF LYNCH
ROAD STREET SEGMENT AND RIGHT-OF-WAY FROM THE NORTH RIGHT-OF-WAY LINE OF
MANCHESTER EXPRESSWAY NORTH TO THE NORTH PROPERTY LINE OF 7716 LYNCH ROAD A/K/A
TAX MAP 127 001 105, TO THE ADJACENT PROPERTY OWNER(S) IN COLUMBUS, MUSCOGEE
COUNTY, GEORGIA.
WHEREAS, Lynch Road was segmented by the construction of the Manchester
Expressway in the early 1960's.; and,
WHEREAS, the City of Columbus, Georgia no longer needed for roadway purposes;
and,
WHEREAS, a reversionary clause will be included to return said property back to
the City should there be a need again for future roadway/interchange
improvements; and,
WHEREAS, it is in the best interest of the Consolidated Government of Columbus,
Georgia to execute a Quit Claim Deed for the segment and right-of-way of Lynch
Road.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY
RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to declare the segment and
right-of-way of Lynch Road from the north right-of-way line of Manchester
expressway north to the north property line of 7716 Lynch Road a/k/a Tax Map
127 001 105 as surplus and execute a Quit Claim Deed to the adjacent owner(s).
The transfer will be subject to reservation of all existing utility easements
of record, known and unknown, with a Reversionary Clause included to return
said property back to the City should the City need it again for future
roadway/interchange improvements and copy of the Quit Claim Deed filed with the
Clerk of Superior Court.
