Planning Advisory Commission's Recommendation: Approval without Conditions based on the fact

that the request is compatible with existing land uses.



Planning Departments Recommendation: Approval with Conditions based on the fact that the

request is compatible with existing land uses. The proposed conditions are as

follows:



1. Condition #1 from Ordinance 07-64 shall be deleted.

2. Condition #2 from Ordinance 07-64 shall be amended to allow office,

mini-storage, and convenience stores with gas sales only.

3. Properties shall be limited to one monument sign each. Signs for single

businesses shall not exceed thirty-six (36) square feet and a height of six (6)

feet. Joint identification signs for multiple businesses at one location shall

have a monument sign not to exceed sixty-four (64) square feet in size and a

height of eight (8) feet.

4. Gas station pump islands must be mostly obscured from view from St. Mary?s

Road, either through location or by plantings or other methods. Pump islands

shall only house gas pumps, windshield-cleaning materials, and trash

receptacles. Canopies for gas pumps shall have architectural style and detail

such as gabled or hip roofs with a three to twelve roof pitch or higher. All

support columns shall be brick, brick veneer, or stone construction. Canopies

shall only display logo identification signs. No other advertising is allowed.

5. Billboards shall not be allowed on these properties

area. The developer will need an approved drainage plan prior to issuance of a

on the transportation network.



This site shall meet the Codes and regulations of the Columbus Consolidated

Government for commercial usage.

Attitude of Property Owners: Twenty Eight (28) property owners within 300 feet of the

subject properties were notified of the rezoning request. The Planning

Department has not received any comments in regards to this case.



Additional Information: The purpose of this rezoning request is to remove the conditions

established under Ordinance #07-64 approved on September 18, 2007 as part of

rezoning case # ZC0705-2. The approved conditions are as follows: 1) The site

plan developed by Ray Underwood, Architect, dated May 12, 2006 is hereby

incorporated by reference and made a part of this ordinance. 2) The property

subject to rezoning shall be limited to office and mini-storage use only.



Back in 2007, the applicant proposed to build mini storage units and offices,

but he was not able to build them. Now, he would like to use the existing 1,761

sq. ft structure and add an additional 900 sq. ft building to create a

convenience store with 4 gas pumps. He is planning to add 13 parking space sand

possibly build a car wash facility.



A convenience store with gas sales is allowed under General Commercial zoning

district, but since the request was approved with conditional uses, a

convenience store will not be allowed unless the conditions are removed. The

applicant is requesting to remove both conditions listed under Ordinance #07-64.
