An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at 2780 Smith Road from RE1 (Residential Estate 1) District to HMI

(Heavy Manufacturing / Industrial) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from RE1 (Residential

Estate 1) District to HMI (Heavy Manufacturing / Industrial) District:



All that lot, tract or parcel of land situate, lying and being in Land Lot 201

of the 19th District of Columbus, Muscogee County, Georgia, and being more

particularly described as follows:



Beginning at an iron pin located at the intersection of the south line of Land

Lot 201 and the easterly margin of Smith Road; thence running the following

courses and distances along the easterly margin of Smith Road: North 10 degrees

42 minutes 48 seconds East a distance of 464.12 feet, along a curve having a

radius of 917.951 feet a distance of 116.81 feet, along a curve having a radius

of 548.64 feet a distance of 375.61 feet to a point; and along a curve having a

radius of 617.526 feet a distance of 381.48 feet to a point in the center of

Heiferhorn Creek; thence running the following courses and distances along the

center line of Heiferhorn Creek: North 49 degrees 05 minutes 13 seconds East a

distance of 200.0 feet to a point, North 59 degrees 57 minutes 25 seconds East

a distance of 185.35 feet to a point, thence South 84 degrees 35 minutes 45

seconds East a distance of 269.79 feet to a point, thence North 08 degrees 26

minutes 55 seconds East a distance of 124.34 feet to a point, thence North 14

degrees 27 minutes 32 seconds East a distance of 51.53 feet to a point, thence

North 56 degrees 19 minutes 11 seconds East a distance of 78.26 feet to a

point, thence North 54 degrees 26 minutes 32 seconds East a distance of 215.0

feet to a point, thence South 45 degrees 47 minutes 20 seconds East a distance

of 124.53 feet to a point, and thence along a curve having a radius of 58.052

feet a distance of 100.85 feet to a point on the easterly margin of Land Lot

201; and thence running South 00 degrees 37 minutes 07 seconds West along said

easterly margin of Land Lot 201 a distance of 375.76 feet to an iron stake;

leaving the easterly margin of Land Lot 201, run South 58 degrees 59 minutes 18

seconds West a distance of 262.33 feet to a point; thence run along the arc of

a curve to the left (said curve having a radius of 380.0 feet) a distance of

291.82 feet to a point; run thence South 11 degrees, 28 minutes, 50 seconds

West a distance of 879.69 feet to a point on the southerly land lot line of

Land Lot 201; thence run westerly along said southerly land lot line for a

distance of 167.55 feet to a point, which point marks the POINT OF BEGINNING.

And

All that lot, tract or parcel of land situate, lying and being in Land Lot 200

of the 19th District of Columbus, Muscogee County, Georgia, more particularly

described as follows:



Beginning at an iron pin located at the intersection of the westerly line of

Fortson Road with the northwest line of the right of way of the Central of

Georgia (southern) Railway; run south 42 degrees 32 minutes west along the

northwest line of the right of way of Central of Georgia Railway 449 feet to an

iron stake; run north 89 degrees 33 minutes west 1,635 feet, more or less, to

Heiferhorn Creek which is the point of beginning; run thence north 89 degrees

33 minutes west, 925 feet, more or less, to the west line of Land Lot 200; run

thence south 0 degrees 56 minutes west along the west line of Land Lot 200, 800

feet, more or less, to Heiferhorn Creek; run northeasterly along Heiferhorn

Creek, following the southeast channel when it splits, 1,350 feet, more or

less, to the point of beginning.



The above-described property is being rezoned with the following conditions:



1. Petitioner or its successor shall maintain a 100-foot mining buffer adjacent

to the right-of-way of Interstate-185.



2. Any new pit on the property subject to rezoning shall be located and

certified by civil engineers and a copy of such certification shall be

delivered to the Columbus Director of Engineering.



3. Any wetlands will be delineated by the Corp of Engineers and such

delineation shall be delivered to the Columbus Director of Engineering before

construction work begins.



4. No exits or entrances shall be permitted onto or from Fortson Road, except

for security or maintenance personnel. No vehicles for mining activities shall

use any exit or entrance onto or from Fortson Road.



5. Blasting particle velocity shall be limited to the US Bureau of Mines

Standard RI 8507 for all structures, including designated historic

structures.



6. If the existing crusher is moved or if a new crusher is installed, such

crusher shall be located in a pit.



7. A 30-foot high berm shall be constructed, planted and maintained by

Petitioner or its successor behind the Getzen House. After planting matures,

said berm shall reach a height of at least 40 feet. Said berm shall be located

in the 300-foot buffer required along Fortson Road.



8. The following uses shall not be permitted on the property subject to

rezoning:

a. Hazardous waste disposal facility.

b. Railroad yard.

c. Sanitary landfill.

d. Utility plant (major, minor or any other type).

e. Junk, salvage, or auto wrecking yard.

f. Recycling collection facility.

the 20th day of December, 2005; introduced a second time at a regular meeting

of said Council held on the day of _ , 2005 and adopted at said

meeting by the affirmative vote of members of said Council.
