An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at 7201, 7221 & Part of 7001 Livingston Drive (parcel 081-001-020,

081-001-021 & part of 072-003-004A) from SFR1 (Single Family Residential 1)

Zoning District to GC (General Commercial) with conditions Zoning District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Department is hereby

amended by changing the aforementioned property from SFR1 (Single Family

Residential 1) Zoning District to GC (General Commercial) with conditions

Zoning District:



Parcel One:

All of that tract or parcel of land lying in and being part of Land Lot 22, 8th

District, Columbus, Muscogee County, Georgia being more particularly described

as follows: Begin at an iron stake marking the intersection of the southerly

line of Whittlesey Boulevard and the westerly line of Livingston Drive; thence

South 00 degrees 18 minutes 52 seconds West, along the westerly line of

Livingston Drive; 649.96 feet to an iron stake; thence leaving the westerly

line of Livingston Drive, North 89 degrees 46 minutes 37 seconds West, 611.93

feet to an iron stake; thence South 33 degrees 56 minutes 25 seconds West,

245.30 feet to an iron stake; thence South 85 degrees 40 minutes 44 seconds

West, 172.0 feet to an iron stake; thence North 00 degrees 33 minutes 03

seconds East, 217.67 feet to an iron stake; thence North 00 degrees 36 minutes

30 seconds East, 484.85 feet to an iron stake on the southerly line of

Whittlesey boulevard; thence along the southerly line of Whittlesey Boulevard,

along the arc of a clockwise curve (said arc having a radius of 697.0 feet and

being subtended by a 1.75 foot chord bearing North 78 degrees 08 minutes 18

seconds East), 1.75 feet to an iron stake; thence continue along said street

line, North 77 degrees 18 minutes 24 seconds East, 657.82 feet to an iron

stake; thence continue along said street line, along the arc of a clockwise

curve (said arc having a radius of 706.0 feet and being subtended by a 159.91

foot chord bearing North 83 degrees 48 minutes 34 seconds East), 160.25 feet to

an iron stake; thence continue along said street line, South 89 degrees 41

minutes 17 seconds East, 114.28 feet to an iron stake and the POINT OF

BEGINNING: containing 13.46 acres.

The above-described property is being rezoned with the following

conditions:

1. Buffering shall include a 20-foot landscaped strip to be designed by a

registered landscape architect located along the 412 ?foot common property line

with 7007 Livingston Drive as well as an 8-foot shadow box wooden fence. A

30-foot undisturbed naturally vegetated buffer shall be maintained along the

southwest property line with the Georgia Power Easement.



2. The developer shall pay for the installation of signalization at the main

entrance of the development along Whittlesey Boulevard.



3. The developer shall install a third lane along the parcels boundary with

Whittlesey Boulevard.



4. The developer shall lengthen and improve the westerly bound left turning

lane on Whittlesey Boulevard.



5. The following list shall be prohibited uses.



a. Storage Yards for damaged or confiscated automobiles

b. Cemeteries and mausoleums

c. Drive-In Theater

d. Adult entertainment Establishment

e. Flea market

f. Crematories

g. Fairgrounds

h. Bowling alley

i. Night club or discotheque

j. Second hand store

k. Mobile home park or trailer court (except temporary use for construction

trailers)

l. Dumping, disposing, incineration, or reduction of garbage (exclusive or

appropriately screened dumpsters to service any building)

m. Any fire sale, bankruptcy sale (unless pursuant to a court order)

n. Central laundry or dry cleaning plant or laundromat

o. Automobile, truck or RV sales, leasing, display or repair

p. Skating rink,

q. Living quarters, sleeping apartments, or lodging rooms

r. Mortuary

s. Pawn shop

t. Bingo club

u. Auction house

v. Establishment selling pornographic materials

w. Tattoo parlor

x. ?Head shop? or business or facility selling, supplying, dispensing or

distributing Marijuana or products or by-products derived therefrom, whether by

prescription, medical recommendation or otherwise.



6. All development lights shall be directed internally.
