(ZC0806-2) Request to amend the text of the Unified Development Ordinance (UDO)
regarding minimum lot size and Places of Worship.
Gateway Assemblies of God, Inc. is requesting that Places of Worship located on
property less than 2 acres in size, but greater than 1 acre in size, be
permitted in all zoning districts, except MHP, LMI, & HMI, as a Special
Exception Use. The Special Exception Use requirement allows for staff and PAC
to have review oversight and Council to have approval/denial authority of a
place of worship that falls under the aforementioned criteria. The changes are
cited below:

Amend Section 3.2.53 Places of Worship as it relates to Location
Amend C.2. Special Exception Use to read as follows:
C. Location.
Special Exception Use.
(A) A place of worship with 250 or more permanent seats or approved capacity
may be located as a special exception use as provided in Section 3.1.1.
(B) A place of worship located on property that is less than 2 acres but
greater than 1 acre may be located as a special exception use as provided in
Section 3.1.1.
Amend Section 3.2.53 Places of Worship as it relates to Minimum Lot Size
Amend F.2. Minimum Lot Size to read as follows:
Additional Standards.
2. Minimum Lot Size. Minimum lot size for a freestanding place of worship is
2 acres, unless it qualifies as a special exception use per Section
3.2.53.C.2.B.

The Planning Advisory Commission considered this text amendment at their
meeting on July 16, 2008. The Planning Advisory Commission recommended
approval.
The Planning Department recommends approval.
