SUBJECT: Concurrent Jurisdiction at National Infantry Museum



INITIATED BY: David Arrington, Deputy City Manager





Recommendation: Approval is requested to execute a Memorandum of

Agreement with the Federal Government providing for concurrent jurisdiction at

the National Infantry Museum.



Background: The National Infantry Museum and the Department of Army

(DOA) have been working on providing concurrent jurisdiction for the property

at the museum for several years. The Department of the Army has a lease hold

interest in the museum and surrounding grounds. The lease hold interest

includes the NIM building and parking lot consisting of approximately 30 acres.

The museum houses artifacts owned by the DOA and utilize the museum as part of

their training program. Several civil service employees are located at the

facility and other official meetings and ceremonies are held on the grounds.

Due to the routine activities associated with the DOA activities on the

property, it was deemed necessary for public safety purposes for the federal

government to have concurrent jurisdiction in the event of an emergency.



In the last legislative session, the State of Georgia adopted O.C.G.A.

50-2-23-2 ceded concurrent legislative jurisdiction over approximately 90.63

acres to the federal government. Of the 90.63 acres, approximately 30.28 acres

is within the limits of Columbus, Georgia. It is necessary for the City to also

agree to concurrent jurisdictions with the Federal Government as part of this

agreement.



Analysis: The execution of this agreement provides for additional public

safety asset to be available for response to emergencies at the National

Infantry Museum. The facility is routinely utilized by the Department of Army

through a lease hold interest for training, meeting, and other events.

Concurrent jurisdiction would provide for DOA personnel to legally respond to

the museum and surrounding property as needed. The agreement would not inhibit

the response of City public safety personnel to request for emergency

assistance.



Financial Considerations: This action has no financial impact.



Projected Annual Fiscal Impact Statement: There will be no annual fiscal

impact.



Legal Considerations: Council approval is required for the City Manager to

execute the Memorandum of Agreement.



Recommendations/ Actions: Authorize the City Manager to execute a Memorandum

of Agreement with the Federal Government providing for concurrent jurisdiction

at the National Infantry Museum.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF

UNDERSTANDING WITH THE UNITED STATES GOVERNMENT TO PROVIDE FOR CONCURRENT

JURISDICTION ON APPROXIMATELY 30 ACRES AT THE NATIONAL INFANTRY MUSEUM.

WHEREAS, the Department of the Army holds a lease-hold interest on property at

the National Infantry Museum to include the museum and parking lot for the

purpose of training soldiers and maintains a staff of Department of Army civil

service personnel on the premises of the museum; and,

WHEREAS, the National Infantry Museum maintains artifacts owned by the

Department of the Army; and,

WHEREAS, in 2013 the State of Georgia adopted O.C.G.A. 50-2-23-2 ceding

concurrent legislative jurisdiction over approximately 90.63 acres to the

federal government; and,

WHEREAS, approximately 30 acres of the lease hold property utilized by the

Department of Army is within Columbus, Georgia encompassing the National

Infantry Museum and adjacent parking lot; and,

WHEREAS, it is a matter of public safety that the City authorize concurrent

jurisdiction of the approximately 30 acres consisting of the National Infantry

Museum and adjacent parking lot to provide for emergency response by Department

of Army personnel and contractors as may be deemed necessary in an emergency

situation.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO EXECUTE A MEMORANDUM OF

UNDERSTANDING WITH THE UNITED STATES GOVERNMENT TO PROVIDE FOR CONCURRENT

JURISDICTION ON APPROXIMATELY 30 ACRES AT THE NATIONAL INFANTRY MUSEUM.
