SUBJECT: FY2012 Grant Application for GDOT/FTA 5303 Planning

Assistance, FTA/GDOT 5307 Capital and Planning Assistance, and FTA 5309

Discretionary Capital

Recommendation: Approval to authorize the Department of Transportation/METRA

to apply to the Federal Transit Administration (FTA) and the Georgia Department

of Transportation (GDOT) for capital and planning grants or otherwise awarded

amounts available. Approval is also requested to authorize the City Manager or

Mayor to accept grant funds if approved and execute contracts with FTA and GDOT.



Background: The city has applied annually for capital and planning grants to

the Federal Transit Administration and the Georgia Department of Transportation

since 1972. The Federal Transit Administration Grants are funded in the

following manner.

The Georgia Department of Transportation and Federal Transit Administration

provides capital and planning funds based on State transit appropriations and

Federal transportation formula allocations, respectively. The city government

provides the required match on grants to the Federal Transit Administration and

Georgia Department of Transportation and has done so since 1972. *Funding from

Georgia Department of Transportation may be curtailed based on State budgeting

constraints.

Financial Considerations: If the City does not apply for the grants, Columbus

would turn down $1,711,244 in federal and $286,947 in state funds to support

public transportation to our local community.



Projected Annual Fiscal Impact Statement: The provision of over a million

passenger transit trips annually, and the purchase of capital equipment (e.g.,

transit buses) needed to support the safe transport of citizens within the

urbanized area of Columbus.



Legal Considerations: The intent to apply for a Federal transit grants listing

the Program of Projects (POP) must be advertised in the local paper. A

resolution must be submitted with the application from the City Council

authorizing application for a grant, authorizing the City Manager or Mayor to

accept the grant and enter into a contract with the Federal Transit

Administration and the Georgia Department of Transportation.



Recommendations/ Actions: Authorize a resolution to approve the City to submit

an application for capital and planning grants from the Federal Transit

Administration and the Georgia Department of Transportation in the total amount

of $1,998,191 and further authorizing the City Manager or Mayor to accept the

grants, if approved, and enter into a contract with the Federal Transit

Administration and the Georgia Department of Transportation.

A RESOLUTION AUTHORIZING THE CITY MANAGER OF COLUMBUS, GEORGIA TO SUBMIT AN

APPLICATION FOR, AND IF AWARDED, ACCEPT A GRANT IN THE AMOUNT OF $100,418, OR

OTHERWISE AWARDED, FROM THE DEPARTMENT OF TRANSPORTATION, UNITED STATES OF

AMERICA, AND GEORGIA DEPARTMENT OF TRANSPORTATION, UNDER TITLE 49 U.S.C.,

SECTION 5303.



WHEREAS, the Secretary of the US Department of Transportation and the

Commissioner of the Georgia Department of Transportation are authorized to make

grants for mass transportation projects; and,



WHEREAS, the contract for financial assistance will impose certain

obligations upon the applicant, including the provision of the City share of

the project costs, $11,157; and,



WHEREAS, the FY2012 UPWP indicates the amount of the Section 5303 funds and the

state share by the Georgia Department of Transportation as $100,418; and,



WHEREAS, it is required by the U.S. Department of Transportation in

accord with the provisions of Title VI of the Civil Rights Act of 1964, that in

connection with the filing of an application for assistance under Title 49

U.S.C. the Applicant gives an assurance that it will comply with Title VI of

the Civil Rights Act of 1964 and other pertinent directives and the U.S.

Department of Transportation requirements there under; and,



WHEREAS, it is the goal of the Applicant that Minority Business

Enterprise (Disadvantaged Business Enterprise and Women?s Business Enterprise)

be utilized to the fullest extent possible in connection with this project, and

that definitive procedures shall be established and administered to ensure that

minority business shall have the maximum feasible opportunity to compete for

contracts and purchase orders when procuring construction contracts, supplies

equipment contracts, or consultant and other services.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES AS

FOLLOWS:

(1)

That the City Manager or his designee, herein referred to as the

Official, are authorized to execute and file an application on behalf of the

Consolidated Government of Columbus, Georgia with the Georgia Department of

Transportation, to aid in the financing of a technical study grant to implement

specific items of the FY2012 Unified Planning Work Program;

(2)

That the Official is authorized to execute and file with such

application and assurance or any other document required by the U.S. Department

of Transportation and the Georgia Department of Transportation effectuating the

purposes of this grant;

(3)

That the Official is authorized to furnish such additional information

as the U.S. Department of Transportation and the Georgia Department of

Transportation may require in connection with the application or the project;

(4)

That the Official is authorized to set forth and execute Minority

Business Enterprise, DBE (Disadvantaged Business Enterprise) and WBE (Women

Business Enterprise) policies and procedures in connection with the project?s

procurement needs; and,

(5)

That the Official is authorized to execute a grant agreement on behalf

of the Consolidated Government of Columbus, Georgia with the Georgia Department

of Transportation to aid in the financing of a technical study grant to

implement specific items of the Columbus, Georgia Unified Planning Work Program.

A RESOLUTION AUTHORIZING THE MAYOR OR CITY MANAGER OF COLUMBUS, GEORGIA TO

SUBMIT AN APPLICATION FOR, AND IF AWARDED, ACCEPT A GRANT IN THE AMOUNT OF

$1,492,232 OR OTHERWISE AWARDED, FROM THE FEDERAL TRANSIT ADMINISTRATION (FTA)

AND GEORGIA DEPARTMENT OF TRANSPORTATION (GDOT) FOR FY2012 CAPITAL AND PLANNING

ASSISTANCE UNDER TITLE 49 U.S.C. SECTION 5307 AND TO CONTRACT WITH FTA AND GDOT

ON BEHALF OF THE CITY SHOULD THE APPLICATION RECEIVE APPROVAL.



WHEREAS, under the Title 49 U.S.C., Section 5307, the Secretary of the

Department of Transportation, United States of America (USDOT) is authorized to

make grants for mass transit planning and capital improvement; and,



WHEREAS, the Columbus Department of Transportation/METRA is designated the

recipient of these transit funds; and,



WHEREAS, the City owns and operates the Columbus Department of

Transportation/METRA, the public transit operates in Columbus, Georgia

Urbanized Area; and,



WHEREAS, the City may apply to FTA for an assistance contract covering up to

eighty percent (80%) of the eligible planning and capital improvement expenses

for the City; and,



WHEREAS, the City may apply to the Georgia Department of Transportation (GDOT)

for a contract for capital and planning assistance covering up to ten percent

(10%) of eligible expenses of the non-FTA share; and,



WHEREAS, such contracts will impose certain obligations upon the City including

the provision of the local share of project costs; and,



WHEREAS, FY2012 shares for these programs as currently projected are:

WHEREAS, in connection with the filing of an application for assistance under

the U.S.C., USDOT requires, in accordance with the provisions of the Title VI

of the Civil Rights Act of 1964, that the applicant gives an assurance that

will comply with Title VI and all USDOT requirements thereunder; and,



WHEREAS, it is the goal of the City to utilize disadvantaged businesses

enterprises (DBEs) to the greatest extent practical in the City procurement

under this project, and to establish and administer definitive procedures to

ensure that DBEs shall have the maximum feasible opportunity to compete in City

procurement for supplies, equipment, construction, and consultant or other

services.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS

FOLLOWS:



(1)

That the Mayor or City Manager is authorized to apply to FTA on behalf

of the City for FY2012 capital and planning financial assistance;

(2)

That the Mayor or City Manager is authorized to apply to GDOT on behalf

of the City for FY2012 capital and planning assistance to match FTA assistance;

(3)

That the Mayor or City Manager is authorized to execute contracts in

accordance with FY2012 expenses on behalf of the City with FTA and GDOT for the

purpose of receiving FTA and GDOT funds should the application be approved;



(4)

That the City gives assurance that, should such contract be executed,

it is the intent of the Council to commit its local share of capital, planning,

and operating costs under the FY2012 Program of Projects;



(5)

That the Mayor or City Manager is authorized to execute (or to delegate

to the Department of Transportation/METRA) and file with such application any

assurance or other documents required by USDOT or FTA in connection with the

application, including any assurance concerning the purpose of the Title VI of

the Civil Rights Act of 1964;



(6)

That the Department of Transportation/METRA is authorized to furnish

such additional information as may be required in connection with the

application, and to requisition federal or state funds to reimburse the City

for eligible expenses under any resulting grant contract;



(7)

That the DBE Coordinator, as the DBE Affirmative Action Liaison Officer

for the City, is authorized to establish and administer DBE policies in

connection with projects procurement needs.

A RESOLUTION AUTHORIZING THE CITY MANAGER OF COLUMBUS, GEORGIA TO FILE AN

APPLICATION WITH THE FEDERAL TRANSIT ADMINISTRATION; AND THE GEORGIA DEPARTMENT

OF TRANSPORTATION FOR FEDERAL TRANSPORTATION ASSISTANCE AUTHORIZED BY 49USC

CHAPTER 53, TITLE 23 UNITED STATES CODE, AND OTHER FEDERAL STATUTES

ADMINISTERED BY THE FEDERAL TRANSIT ADMINISTRATION.



WHEREAS, the Federal Transit Administrator has been delegated authority to

award federal financial assistance for the purchase of two (2) clean air diesel

transit buses; and,



WHEREAS, the grant or cooperative agreement for federal financial assistance

will require the Columbus Consolidated Government to apply a 32% match

($100,988) for the purchase of two (2) clean air diesel transit buses; and,



WHEREAS, the local match, $100,988 to be used to purchase two (2) clean air

diesel transit buses will come from the 1999 Special Local Option Sales Tax

Fund, designated for the purchase of clean air diesel buses; and,



WHEREAS, the Columbus Consolidated Government has provided all annual

certifications and assurances to the Federal Transit Administration required

for the project.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES AS FOLLOWS:

(1)

That the City Manager is hereby authorized to execute and file an application

for Federal assistance on behalf of METRA Transit System with the Federal

Transit Administration and the Georgia Department of Transportation for Federal

assistance authorized by 49 U.S.C. Chapter 53, Title 23, United States Code, or

other Federal statues authorizing a project administered by the Federal Transit

Administration. The Georgia Department of Transportation, the Designated

Recipient as defined by 49 U.S.C. Section 5307 (a)(2), will apply on behalf of

METRA Transit System for 5309 Capital Program funds;



(2)

That the City Manager hereinafter referred to as the Official is authorized to

execute and file with its applications the annual certifications and assurances

and other documents the Federal Transportation Administration and Georgia

Department of Transportation require before awarding a Federal assistance grant

or cooperative agreement;



(3)

That the City Manager is authorized to execute the grant and cooperative

agreements with the Federal Transit Administration and the Georgia Department

of Transportation on behalf of METRA Transit System.
