BOARD OF ZONING APPEALS
REGULAR MEETING - 2:00 P.M. ? FEBRUARY 6, 2008
The Regular Meeting of the Board of Zoning Appeals was held Wednesday, February
6th, 2008, at 2:00 P.M., on the 1st Floor of the Government Center Annex in the
conference room, 420-10th Street. Mr. Billy Edwards, Board Chairman, called
the meeting to order. The board members present were:
Mr. Ralph King
Mr. Perry Borom
Mr. Wright Wade
Mr. Willie Lewis, Jr.
Also present representing the Inspections and Code Enforcement Department was
Mr. Danny Cargill, Secretary of the Board, Mrs. Millicent Burden, Recording
Secretary and Tracy Hall from the Planning Department.
CASE NO. 08-V0001?GRANTED
David M. Shank, 1563 Doubletree Drive, to reduce the rear yard setback
requirement from 30 ft to 22 ft for a covered deck. The property is zoned SFR3.
Mr. Shank stated that he wanted to replace the existing open deck with a
covered deck. The property behind his home is wetland. He will not be
encroaching on any property lines. The materials will match the existing
house. He plans on installing gutters and the water runoff will go toward the
back into the wetland.
There was no opposition present for this appeal.
Mr. Borom made a motion to grant this appeal. Mr. Wade seconded the motion.
Motion carried unanimously.
CASE NO. 08-V002 & 08-V003--GRANTED
John Lyles, 827 Winall Drive, Lots 101 & 102, to reduce the minimum lot width
requirement from 75 ft to 50 ft to erect a single-family residence. The
property is zoned SFR2.
Mr. Lyles stated that the homes would be approximately 1500 sq ft. Currently,
there is an old modular building on the site. He presented photos of houses
similar to the ones that he plans to build. There are several lots in the area
that have been subdivided with similar widths.
Tracy Hall from the Planning Department stated that they had no position on the
request noting that the width was very narrow.
There was no opposition present for this appeal.
Mr. Wade made a motion to grant this appeal. Mr. Lewis seconded the motion.
Motion carried unanimously.
CASE NO. 08-V004?GRANTED
James Johnson of Neighbor Works Columbus, 1344 23rd Street, to reduce the
corner side yard setback requirement from 20 ft to 17 ft to erect a
single-family residence. The property is zoned RMF1.
Mr. Johnson stated that they purchased the property and subdivided it into 4
lots. This would be the smallest house on the block, but he needs the
encroachment to enhance the property. Currently the lot is vacant.
There was no opposition present for this appeal.
Mr. Borom made a motion to grant this appeal. Mr. King seconded the motion.
Motion carried unanimously.
CASE NO. 08-V005--GRANTED
Billy Hanson of Signs, Inc., 3759 Victory Drive, to increase the number of
signs allowed from 2 to 6; and to increase the square footage allowed from 300
to 1328 total. The property is zoned GC.
Mr. Hanson stated that there is an existing steel pole structure at the old
Burger King location. He is asking for permission to install a sign on that
pole. The new sign would be smaller than the old one.
Mr. Cargill confirmed that the signs are existing non-conforming.
There was no opposition present for this appeal.
Mr. Wade made a motion to grant this appeal. Mr. King seconded the motion.
Motion carried 3 to 1.
CASE NO. 08-V006--DENIED
Bobby Dean of Barrett-Simpson, Inc., 7601 River Road, to reduce the side yard
setback requirement from 15 ft to 0; and to reduce the side yard buffer
requirement to 133 ft x 10 ft for a proposed convenience store. The property
is zoned GC.
Mr. Dean stated that they would like to increase the square footage of the
building. The building would be sitting back farther than the rest. The water
will runoff to a pond through downspouts. The building will touch the lot line
in three places.
There was no opposition present for this appeal.
Mr. King made a motion to deny this appeal. Mr. Borom seconded the motion.
Motion carried unanimously.
CASE NO. 08-V007?GRANTED
Warren Mason of Moon, Meeks, Mason & Vinson, Inc., 6131 Crystal Drive, to
reduce the rear yard setback requirement from 40 ft to 25 ft for a proposed
apartment community. The property is zoned RO.
Mr. Mason stated that unit affected is #4. His client wants to install a fence
and allow the adjacent property owner access to the structure. The apartments
would be similar to the pre-existing ones in the area.
There was no opposition present for this appeal.
Mr. King made a motion to grant this appeal. Mr. Borom seconded the motion.
Motion carried unanimously.
CASE NO. 08-V008?GRANTED
Warren Mason of Moon, Meeks, Mason & Vinson, Inc., 2960 Macon Road, to reduce
the required number of off-street parking from 384 to 331; and to omit 2
islands from the landscaping. The property is zoned GC.
Mr. Mason stated that based on the square footage of the building, the 384
spaces are required by the UDO. The 331 spaces fit the facilities need. He
also stated that there is more than enough space for the landscaping
requirements. There will be access through Rigdon and Macon Roads as well as
the library entrance.
There was no opposition present for this appeal.
Mr. Lewis made a motion to grant this appeal. Mr. Borom seconded the motion.
Motion carried unanimously.
Mr. King made a motion to accept the minutes from the January meeting. Mr.
Lewis seconded the motion. Motion carried unanimously.
There being no further business to come before the Board, the meeting adjourned
at 2:49 p.m.
