SUBJECT: Abandonment of a 10' Drainage and Utility Easement

Located on the North Eastern Property Line of Lot 27 Block D-Green Island Hills

Subdivision



INITIATED BY: Engineering





Recommendation: Approval is requested to execute a Quit Claim Deed to John D.

Johnston, Jr. and Carol W. Johnston for abandonment of a 10' drainage and

utility easement located on the northeastern property line of Lot 27 Block D

Green Island Hills Subdivision.



Background: Homeowners John D. Johnston, Jr. and Carol W. Johnston submitted a

variance request in order to build a 10' x 22' addition to their home known as

Lot 27 Block "D" located in Green Island Hills Subdivision at which time he was

notified that the structure addition fell into an exiting 10' drainage and

utility easement. All known utilities have been contacted and agree to the

abandonment of the 10' existing drainage and utility easement running along the

north side of the property line approximately 265.94 feet as shown on the

highlighted survey.



Analysis: William Pound, Esq., Attorney for the homeowners John D. Johnston,

Jr. and Carol W. Johnston, submitted a request to the Engineering Department

requesting the entire 10' drainage and utility easement be abandoned in order

to construct a 10' x 22' closet addition to the existing house. After checking

with the utility companies, it is in agreement that the entire existing 10'

easement along the north side of the property line for approximately 265.94

feet can be abandon. The Engineering Department has found no present or future

use of existing easement. The remainders of all utility easements of record in

effect and providing with as required by the applicable utility companies will

be required for unknown utilities, repealing any conflicting ordinances, and

for other purposes.

Legal Considerations: The Council must approve the action by resolution.

Deed to John D. Johnston, Jr. and Carol W. Johnston for abandonment of a 10'

drainage and utility easement located on the north eastern property line of Lot

27 Block D Green Island Hills Subdivision in order to construct a 10' x 22'

addition to the existing house.

A RESOLUTION AUTHORIZING AUTHORIZING THE CITY MANAGER OF COLUMBUS, GEORGIA TO

EXECUTE A QUIT CLAIM DEED TO JOHN D. JOHNSTON, JR. AND CAROL W. JOHNSTON FOR

THE EXISTING DRAINAGE AND UTILITY EASEMENT AS SHOWN ON LOT 27 BLOCK "D" GREEN

ISLAND HILLS SUBDIVISION.

WHEREAS, a ten (10) foot wide existing drainage and utility easement located on

the north eastern side of Lot 27 Block "D" Green Island Hills Subdivision was

requested to be abandon in order to construct a 10' x 22' addition to the

existing home; and,

WHEREAS, the aforementioned ten (10) foot drainage and utility easement is no

longer in use and has been formally abandoned by all parties concerned; and,

WHEREAS, Columbus, Georgia has no other use for the aforementioned ten (10)

foot drainage and utility easement. The remainders of all drainage and utility

easements of record remain in effect and providing appropriate width as

required by the applicable utility companies will be required for unknown

utilities, repealing any conflicting ordinances, and for other purposes.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to execute a quit claim deed to John

D. Johnston, Jr. and Carol W. Johnston for the existing ten (10) foot drainage

and utility easement running approximately 265.94 feet along the north eastern

side of Lot 27 Block "D" Green Island Hills Subdivision in order to construct a

10' x 22' addition to the existing home.
