SUBJECT: Enrichment Services Program (ESP) Quit Claim Deed for Regency
Drive Property

Recommendation: Approval is requested to accept a Quit Claim Deed for property
located on Regency Drive from Enrichment Services Program.
Background: In May of 2010, Enrichment Services Program (ESP) was given
approximately 2.07 acres for the property at Regency Drive (097-013-002).
Resolution 158-10 is attached for your review. In that Resolution, ESP agreed
to utilize the property to build a new Head Start Center. The plan was met
with opposition in 2012 and, as a result, ESP abandoned the plan. The
Resolution provided that, should ESP sell or transfer the property, the City
would be paid the Fair Market Value of the land. In this case, ESP is
reverting the property back to the City as they are unable to utilize it for
the intended purpose. A Quit Claim Deed will transfer the property back to the
City's ownership and release ESP from any obligations for the property.
Analysis: The City will receive the property due to the failure of the
project. ESP is released from the obligation.
Financial Considerations: This property will be returned to the City and
disposition can occur to put it back on the tax roll.
Projected Annual Fiscal Impact Statement: The City will recover property
valued at approximately $165,000.
Legal Considerations: Clawback provisions were provided for in the Resolution.
Recommendations/ Actions: Accept the Quit Claim Deed for property located on
Regency Drive from Enrichment Services Program.

A RESOLUTION AUTHORIZING ACCEPTANCE OF A QUIT CLAIM DEED FOR PROPERTY ON
REGENCY DRIVE, TAX MAP 097-013-009, PREVIOUSLY GIVEN TO ENRICHMENT SERVICES
PROGRAM, INC.
WHEREAS, Enrichment Services Program (ESP) provides the Head Start program for
the citizens of Columbus; and,
WHEREAS, the City gave 2.07 parcels of land located on Regency Drive to ESP for
the purpose of building a new Head Start center pursuant to Resolution 158-10;
and,
WHEREAS, ESP met with opposition to this plan and has abandoned the plan to
construct a new Head Start program on this site; and,
WHEREAS, Resolution 158-10 indicates that the City must be made whole in the
event the Head Start program is not built on this site; and,
WHEREAS, Enrichment Services Program is providing a Quit Claim Deed to return
the above shown property to the City.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to accept 2.07 acres of land
located on Regency Drive (Tax Map 097-013-009), given by Quit Claim Deed from
the Enrichment Services Program.
