SUBJECT: Federal Courthouse/Post Office - Dumpster Encroachment



INITIATED BY: Engineering







Recommendation: Approval is requested of a variance and permanent encroachment

into 2nd Avenue right-of-way for a dumpster pad, black steel fencing,

landscaping, security gate controls and bollards adjacent to the Federal

Courthouse/U. S. Post Office located at 120 - 12th Street.



Background: Judge Clay Land submitted a request to the City to relocate the

trash dumpster from the rear parking lot of the site to the 2nd Avenue

right-of-way. An inspection found that the Federal Courthouse/U. S. Post

Office is upgrading site security with the installation of black steel security

fence along the perimeter of the property to include a guard house at the 2nd

Avenue driveway. This work included the installation of vehicular security

entrance controls along 2nd Avenue in the southbound Post Office Mail Box drop

off lane plus a set of steel bollards in the sidewalk on each side of the 2nd

Avenue driveway without an approved encroachment permit.



Analysis: The City Manager, Deputy City Manager and Traffic Engineering

Manager met with Judge Land concerning this request. Judge Land was advised

that the work that was already performed was performed without an approved

permit. And that the installation of trash dumpster on City right-of-way is

prohibited without an approved variance. We advised him that the City will

work with the Courthouse by submitting the appropriate applications to the

Uptown Facade Board and to the Board of Historical and Architectural Review. A

resolution will be submitted to Council for the approval of a variance and

permanent encroachment for said improvements. Copies of the proposed dumpster

design and Board approval letters are attached.



Financial Considerations: There will not be any expenses incurred by the City

for this encroachment. There is a provision in the resolution that said

encroachments shall be removed at no expense to the City should any future road

or right-of-way improvements be needed.



Legal Considerations: A variance to the prohibition of dumpsters on the City

right-of-way and a permanent encroachment in the right-of-way requires Council

approval.



Recommendations/ Actions: Approve the attached variance and permanent

encroachment on 2nd Avenue right-of-way for the Federal Courthouse/U.S. Post

Office.

A RESOLUTION AUTHORIZING A VARIANCE TO CITY CODE SECTION 4.2.1 SCREENING

REQUIRED FOR TRASH AREAS, PARAGRAPH B, 1, (C) PUBLIC RIGHT-OF-WAY. DUMPSTERS

SHALL NOT BE LOCATED WITHIN THE RIGHT-OF-WAY OF A PUBLIC STREET OR ALLEY TO

ALLOW A DUMPSTER, PAD, FENCING AND LANDSCAPING TO BE LOCATED IN THE 2ND AVENUE

RIGHT-OF-WAY AND TO AUTHORIZE A PERMANENT ENCROACHMENT OF SECURITY GATE

CONTROLS, EQUIPMENT AND BOLLARDS IN SAID RIGHT-OF-WAY.

WHEREAS, the Federal Courthouse/U.S. Post Office located at 120 -12th Street is

upgrading site security by the installation of a black steel security fence

around the property perimeter, security gate entrance to include security gate

controls/equipment and bollards on 2nd Avenue right-of-way; and,

WHEREAS, Judge Clay Land request the approval of a variance to install a trash

dumpster on 2nd Avenue right-of-way and allow a permanent encroachment of

security controls and equipment on said right-of-way; and,

WHEREAS, the Engineering Department submitted a design and applications to the

Uptown Facade Board and Board of Historical and Architectural Review for these

installations on right-of-way receiving approvals; and,

WHEREAS, the Federal Courthouse/U.S. Post Office agree to remove any of these

improvements from City right-of-way should they conflict with any future road

or right-of-way improvements within 30 days of receipt of written request by

the City.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

THAT A VARIANCE TO CITY CODE SECTION 4.2.1 SCREENING REQUIRED FOR TRASH

AREAS, PARAGRAPH B, 1, (C) PUBLIC RIGHT-OF-WAY. DUMPSTERS SHALL NOT BE LOCATED

WITHIN THE RIGHT-OF-WAY OF A PUBLIC STREET OR ALLEY IS HEREBY AUTHORIZED TO

ALLOW A DUMPSTER, PAD, FENCING AND LANDSCAPING TO BE LOCATED IN THE 2ND AVENUE

RIGHT-OF-WAY AND TO AUTHORIZE A PERMANENT ENCROACHMENT OF SECURITY GATE

CONTROLS, EQUIPMENT AND BOLLARDS IN SAID RIGHT-OF-WAY. AND THAT SHOULD ANY OF

THESE IMPROVEMENTS BE IN CONFLICT WITH ANY FUTURE CITY IMPROVEMENT, THEY WILL

BE REMOVED AT NO COST TO THE CITY UPON RECEIPT OF WRITTEN NOTICE AS DESCRIBED

HERE WITHIN.
