SUBJECT: Waiver of Demolition Liens



INITIATED BY: Department of Community Reinvestment







Recommendation: Approval is requested to waive demolition lien, penalty and

interest on property located at 2614 7th Street.



Background: In 2003, Pleasant Grove Baptist Church purchased the property

adjacent to the church at 2614 7th Street a/k/a Tax Map 049 001 039, at a

Sheriff's Tax Sale for outstanding property taxes. The property had an

outstanding demolition lien of $6,020.00 which was not included as part of the

sale of the property. The property has accrued penalties and interest on the

demolition lien of $4,706.80 for a total $10,726.80.



Analysis: Section 8-85 of the City Code of Ordinances gives the City Manager

the authority to waive demolition liens when property is transferred to the

Land Bank Authority or other entities obtaining the land with the intent to

develop low-moderate income housing. Since the church is using the property

for church activities and not in accordance with Section 8-85, waiver of the

demolition lien, penalty and interest requires Council approval. The City's

process for recording demolition liens has been modified since 2003 to insure

the liens are satisfied when the property is sold.



Financial Considerations: The City will waive demolition liens plus penalties

and interest totaling $10,726.80.



Projected Annual Fiscal Impact Statement: There will be no annual fiscal impact

by the waiver of the liens/penalties.



Legal Considerations: City Council is required to waive the lien, penalty and

interest.



Recommendations/ Actions: Authorize the City Manager to waive the demolition

lien, penalty and interest for property located at 2614 7th Street in the

amount of $10,726.80.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO WAIVE THE DEMOLITION LIEN

INCLUDING PENALTIES AND INTEREST TOTALING $10,726.80 FOR THE PROPERTY LOCATED

AT 2614 7TH STREET A/K/A TAX MAP #049 001 039 IN COLUMBUS, MUSCOGEE COUNTY,

GEORGIA.



WHEREAS, property located at 2614 7th Street was purchased at a Sheriff?s Sale

by Pleasant Grove Baptist Church to be used for church purposes; and,



WHEREAS, Pleasant Grove Baptist Church has used the property since 2003

for church related activities; and,



WHEREAS, the property was purchased without the payment of the outstanding

demolition lien; and,



WHEREAS, penalties and interest have accrued for a total of $10,726.80.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:



That the City Manager is hereby authorized to waive the outstanding demolition

lien including penalties and interest for the property located at 2614 7th

Street, Columbus, Muscogee County, Georgia.
