SUBJECT: Acceptance of a Deed for additional Right-Of-Way adjacent to

Old Double Churches Road

Recommendation: Approval is requested for the acceptance of a portion of

property along Old Double Churches Road, 0.207 acres.



Background: Bagwell Properties, Inc., submitted a replat to subdivide

property owned on Old Double Churches Road. In compliance with Section 7.4.3 of

the Unified Development Ordinance, the owner was requested to reserve

additional right-of-way for future road improvements. Old Double Churches Road

is currently substandard. The owners of Bagwell Properties decided to go ahead

and deed the additional right-of-way to the City.



Analysis: In compliance with Section 7.4.3. Required Improvements; Minor

Subdivisions. By definition, a minor subdivision does not involve the

construction of major public improvements, such as new streets or stormwater

detention. However, the following improvements are required in order to

adequately serve the lots and protect the safe operation of the existing road:

A. Right-of-way Dedication. Right-of-way shall be dedicated along the

property's frontage from the centerline of the existing road equal to one-half

of the minimum requirement for the classification of the road, as established

in this Chapter.



Financial Considerations: The City will take over the maintenance of this

deeded right-of-way after acceptance of the Deed.



Projected Annual Fiscal Impact Statement: The City will take over the

maintenance of this deeded right-of-way after acceptance of the Deed.



Legal Considerations: In Accordance with Section 18-3 of the Columbus Code,

all dedicated right-of-ways must be accepted by written resolution of Council.



Recommendations/ Actions: Approval is requested of to accept a deed to Part

of Land Lot 82, 8th District 0.207 acres adjacent to Old Double Churches Road

for additional right-of-way for future road improvements per Section 7.4.3 of

the Unified Development Ordinance.















A RESOLUTION

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A DEED TO PART OF LAND LOT 82, 8TH

DISTRICT 0.207 ACRES ALONG OLD DOUBLE CHURCHES ROAD IN ORDER TO BE IN

COMPLIANCE WITH SECTION 7.4.3 OF THE UNIFIED DEVELOPMENT ORDINANCE, THIS

RIGHT-OF-WAY WAS DEEDED TO THE CITY FOR FUTURE ROAD IMPROVEMENT, ON BEHALF OF

COLUMBUS, GEORGIA.

WHEREAS, the owners of Bagwell Properties, Inc., wish to subdivide property

owned along Old Double Churches Road which is currently a substandard roadway;

and,

WHEREAS, during the review of the plat for this subdivide, the Engineering

Department requested additional right-of-way be reserved for future road

improvements per Section 7.4.3 of the Unified Development Ordinance; and,

WHEREAS, Bagwell Properties, Inc., chose to deed this required right-of-way to

the City.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That certain deed dated April 16, 2013, conveying to Columbus, Georgia

Part of Land Lot 82, 8th District 0.207 acres along Old Double Churches Road be

and the same is hereby accepted. The Clerk of Council is hereby authorized to

have said deed recorded in the Deed Records in the Office of the Superior Court

of Muscogee County, Georgia. A copy of the deed is hereto attached and by this

reference made a part of this resolution.
