SUBJECT: Quit Claim of City property
INITIATED BY: Felton G. Grant, Right of Way Acquisition Coordinator
Recommendation: Approval is requested to execute a Quit Claim Deed a portion
of City Right of Way to Schuster Enterprises, LLC (Burger King) at 3101 Gentian
Boulevard.
Background: Schuster Enterprises, LLC (Burger King) at 3101 Gentian Boulevard
has requested a portion of City Right of Way to allow them to construction an
additional Drive Thru Order Station. They have presented a Plat to this Office
consisting of 0.08 acres +/- to be Quit Claimed (Plat Attached).
Analysis: Schuster Enterprises, LLC (Burger King) is prepared to put in
approximately 380 ft. by 5 ft. of sidewalk along Gentian Boulevard at entrance
of Burger King to the corner of University Avenue. A small area of sidewalk
will be less than 2 ft. behind the curb to miss some utility manholes, etc.
Financial Considerations: There will no expense for this action.
Projected Annual Fiscal Impact Statement: N/A
Legal Considerations: Council must approve the action by Resolution
Recommendations/ Actions: Approve the Resolution authorizing the Quit Claim to
Schuster Enterprises, LLC (Burger King) at 3101 Gentian Boulevard.
A RESOLUTION

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ALLOW THE EXECUTION OF QUIT CLAIM
OF CITY PROPERTY TO SCHUSTER ENTERPRISES, LLC (BURGER KING) AT 3101 GENTIAN
BOULEVARD.
WHEREAS, Schuster Enterprises, LLC has requested a portion of City property
adjacent to the Burger King at 3101 Gentian Boulevard to be Quit Claimed to
them for an additional Drive Thru lane, thereby generating more revenue; and,
WHEREAS, Schuster Enterprises, LLC is prepared to install sidewalk along
Gentian Boulevard from their entrances drive to the corner of University
Avenue, approximately 380 ft long X 5 ft wide +/-; and,
WHEREAS, the sidewalk will be less than 2 ft in various places behind the curb
to avoid utility manholes, etc; and,
WHEREAS, there will be no cost to the City. Closing will be done by Schuster
Enterprises, LLC.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is authorized to allow the execution of Quit Claim of
City Property to Schuster Enterprises, LLC at 3101 Gentian Boulevard and
subsequent agreements necessary to implement the project.
