SUBJECT: Dollar General ? Cusseta Road @ 23rd Avenue site

Variance to Buffer and Shared Parking Requirements

Recommendation: Approval is requested of two variances to the City Code for

the development of a new Dollar General store to be located in the northeast

quadrant of Cusseta Road and 23rd Avenue.



Background: Dollar General is redeveloping four lots located at the

intersection of Cusseta Road and 23rd Avenue. Two of the lots, 2301 and 2311

Cusseta Road are zoned General Commercial (GC). Two lots, 318 and 322 ? 23rd

Avenue are zoned Residential Multifamily 2 (RMF2).



Analysis: The two lots along Cusseta Road will be replatted into one lot for

which the building and portion of the parking will be constructed. The two

RMF2 lots along 23rd Avenue will be replatted into one lot. All required

parking cannot be located on the GC lot. Since the proposed parking lot

designed for the Dollar General store would be the same as required for four or

more unit apartment complex for a RMF2 development, a variance is requested to

allow the Dollar General who owns all four lots, to designate parking lot on

23rd Avenue parcel as a Shared Parking lot under City Code Section 4.3.12.

This can be accomplished by a variance with Council approval.



A second variance is requested to eliminate the Type ?C? Buffer between the GC

and RMF2 property lines. The variance would allow for a Type ?C? Buffer with a

15 foot width plus a six foot opaque fence to screen this development perimeter

to the RMF2 lots located to the north and east of this site. The proposed

buffer is shown on the attached site plan that is being made part of the

resolution by reference.



Financial Considerations: There is no cost to the City beyond administrative

cost for permitting and inspections.



Projected Annual Fiscal Impact Statement: There are no future fiscal impacts

to the City.



Legal Considerations: A variance to the City Code requirements for shared

parking requires Council approval.



Recommendations/ Actions: Recommend Council approve the two variances to the

Dollar General development to be located at Cusseta Road and 23rd Avenue.

A RESOLUTION AUTHORIZING A VARIANCE TO THE CITY CODE SECTION 4.3.12 SHARED

PARKING - TO ALLOW A SHARED PARKING LOT FOR A NEW DOLLAR GENERAL TO BE LOCATED

AT 2301 CUSSETA ROAD ON THE LOT LOCATED ADJACENT TO SAID PROPERTY AT 322 - 23RD

AVENUE; A VARIANCE TO CITY CODE SECTION 4.5.7 BUFFER CATEGORIES AND OPTIONS FOR

SIDE OR REAR YARD BUFFERS TO ALLOW FOR TYPE ?C? BUFFER WITH 15 FOOT WIDTH AND

SIX FOOT OPAQUE FENCE FOR THE NORTH AND EAST PROPERTY LINE OF SAID DEVELOPMENT

TO SCREEN ADJOINING RESIDENTIAL MULTIFAMILY 2 LOTS.

WHEREAS, Dollar General is redeveloping property in the northeast quadrant of

Cusseta Road and 23rd Avenue; and,

WHEREAS, two lots along Cusseta Road are being replatted into one General

Commercial lot and two lots along 23rd Avenue are being replatted into one

Residential Multifamily 2 lot; and,



WHEREAS, the new Dollar General building will be constructed on the

General Commercial lot meeting all setback requirements with the need of using

the Residential Multifamily 2 lot for Shared Parking; and,



WHEREAS, the proposed parking lot designed for the Residential

Multifamily 2 lot for the Dollar General development would be the same as

needed for a four unit apartment complex; and,



WHEREAS, City Code Section 4.3.12 Shared Parking encourages the use of

shared parking lots between parcels with Council approval; and,



WHEREAS, the developer has agreed to apply the Type ?C? Buffer of

Section 4.5.7 with 15 foot width and a six foot opaque fence to screen adjacent

Residential Multifamily 2 properties located to the north and east of this

development in accordance with the site plan attached and made part of this

resolution by reference; and,



WHEREAS, the Planning, Engineering and Inspections and Code departments

reviewed this development recommending approval of these variances.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That a variance is hereby authorized to the city code section 4.3.12

shared parking to allow a shared parking lot for a new Dollar General to be

located at 2301 Cusseta Road on the lot located adjacent to said property at

322 - 23rd Avenue; a variance to city code section 4.5.7 buffer categories and

options for side or rear yard buffers to allow for type "C" buffer with 15 foot

width and six foot opaque fence for the north and east property line of said

development to screen adjoining residential multifamily 2 lots.
