SUBJECT: Permanent Easement for Conveyor over Fortson Road



INITIATED BY: Donna Newman, City Engineer





Recommendation: Approval is requested for a permanent aerial encroachment for

an overhead conveyor system into the public right-of-way of Fortson Road

approximately 500 feet north of the intersection of Vulcan Plant Road.



Background: Vulcan Materials requested to construct an overhead conveyor

system to transport mined materials from a quarry site east of Fortson Road to

their plant facility west of Fortson Road. The current quarry operation is

located on the west side of Fortson Road and is approaching the maximum depth

for quarry operation. The plant's processing operation is also located on the

west side of Fortson Road. Vulcan will begin quarry operations on the east

side of Fortson Road within the next two years but plans to continue processing

material at the processing plant on the west side of Fortson Road. The

conveyor system will eliminate the need for numerous trucks to transport

material across Fortson Road daily for processing.



Analysis: Two drawings have been provided. One shows the site layout and

conveyor location. The other shows an elevation drawing of the conveyor

structure. Requiring the structure to be built off of City right-of-way and

providing a 28? clearance over the roadway would be suitable. The conveyor

system will be fully enclosed over the City right-of-way. The structure will

be maintained by Vulcan and constructed to ensure that no materials leave the

conveyor, falling to Fortson Road. The conveyor shall be removed at no cost to

the City if it becomes a conflict with any public improvement projects.



Financial Considerations: There is no financial burden on the City.



Projected Annual Fiscal Impact Statement: There is no fiscal impact.



Legal Considerations: All permanent encroachments require Council approval.



Recommendations/ Actions: Approval is requested for a permanent aerial

encroachment for an overhead conveyor system into the public right-of-way of

Fortson Road approximately 500 feet north of the intersection of Vulcan Plant

Road.



















A RESOLUTION

NO. _____

A RESOLUTION AUTHORIZING A PERMANENT AERIAL ENCROACHMENT OF AN OVERHEAD

CONVEYOR SYSTEM INTO THE PUBLIC RIGHT-OF-WAY OF FORTSON ROAD APPROXIMATELY 500

FEET NORTH OF THE INTERSECTION OF VULCAN PLANT ROAD; SAID ENCROACHMENT IS

APPROVED WITH THE CONDITION THAT SHOULD THE OVERHEAD CONVEYOR EVER BECOME A

CONFLICT WITH ANY FUTURE PUBLIC IMPROVEMENT, THE CONVEYOR SHALL BE REMOVED AT

NO COST TO THE CITY.

WHEREAS, Vulcan Materials desires to construct an overhead conveyor system to

transport mined materials from a quarry site east of Fortson Road to their

plant location west of Fortson Road; and,

WHEREAS, the overhead conveyor system design shall provide a minimum of 28?

vertical clearance above the centerline elevation of Fortson Road to the lowest

supporting structure with the Fortson Road right-of-way remaining free of any

supports or obstructions; and,

WHEREAS, the overhead conveyor will be fully enclosed as it passes over the

City right-of-way; and,

WHEREAS, the overhead conveyor will be removed by Vulcan Materials at no cost

to the City should it ever become a conflict with any future public

improvement; and,



WHEREAS, Vulcan Materials shall hold the City harmless from any

liabilities associated with the operation &/or maintenance of said system &

shall bear the expense of any legal defense from liabilities; and,



WHEREAS, Vulcan shall provide adequate maintenance of said system to

protect the roadway from any falling debris, dust &/or contaminates.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

Authorize a permanent aerial encroachment for an overhead conveyor

system into the public right-of-way of Fortson Road approximately 500 feet

north of the intersection of Vulcan Plant Road; said encroachment is approved

with the condition that should the overhead conveyor ever become a conflict

with any future public improvement, the conveyor shall be removed at no cost to

the City.
