SUBJECT: City Right of Way Agreement for Improvement of 0.07 miles of
Roadway at Riverdale Cemetery
INITIATED BY: Felton G. Grant, Right of Way Acquisition Coordinator
Recommendation: Approval is requested to execute a City Right of Way Agreement
(attached) with the Georgia Department of Transportation (DOT) for a County
Contract for improvement of 0.07 miles of Roadway at Riverdale Cemetery.
Background: DOT will assist the City of Columbus, Georgia in a County Contract
for improvement of 0.07 miles of Roadway at Riverdale Cemetery, Project No.
SO14142-PRC.
Analysis: The City requested assistance from the DOT to enter into a County
Contract on the above referenced project.
Financial Considerations: The DOT agreed to assist in this County Contract and
will contribute approximately $14,839.42 toward the project. After further
discussion with the DOT, this date, they do not expect the project to be more
than the $14,839.42. In case it does, it will come out of CIP fund.
Projected Annual Fiscal Impact Statement: If the Contract to construct said
project is more than $14,839.42, the City will have to pay the difference.
Legal Considerations: Council must approve the action by resolution. The City
Attorney disagrees with the indemnification paragraph, but understands that the
DOT will not change the paragraph in the agreement; therefore, to participate
in this program, the City has to accept it as does every government entity,
statewide.
Recommendations/ Actions: Approval the resolution authorizing the Right of Way
Agreement and subsequent agreements necessary to implement said project as
referenced above.

A RESOLUTION AUTHORIZING TO ENTER INTO A RIGHT OF WAY AGREEMENT WITH THE
GEORGIA DEPARTMENT OF TRANSPORTATION (DOT) FOR A COUNTY CONTRACT FOR
IMPROVEMENT OF 0.07 MILES OF ROADWAY AT RIVERDALE CEMETERY.
WHEREAS, DOT will assist the City of Columbus, Georgia, a Consolidated
City/County Government, into a County Contract for improvement of 0.07 miles of
Roadway at Riverdale Cemetery, SO14142-PRC, Muscogee County; and,
WHEREAS, DOT is providing approximately $14,839.42 toward the above mentioned
project and does not expect it to exceed that amount. If necessary, the City
will pay the difference of the Contract Bid from the CIP
0508-660-300-20300-20030; and,
WHEREAS, the project will extend wholly within the corporate limits of
Columbus, Georgia, under the laws of the State of Georgia.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to execute a City Right of Way
Agreement and subsequent agreements necessary to implement the project with the
Georgia Department of Transportation for a County Contract for improvement of
0.07 miles of Roadway at Riverdale Cemetery Project No. SO14142-PRC, Muscogee
County.
