 SUBJECT:	City Right of Way Agreement for an Intersection/Bridge    
 Improvement on Mutec Drive (Corporate Ridge ) and Woodruff Farm Road.       
 INITIATED BY: Felton G. Grant, Right of Way Acquisition Coordinator           
 Recommendation:  Approval is requested to execute a City Right of Way Agreement    
 (attached) between the Georgia Department of Transportation (GDOT) and the City    
 of Columbus, Georgia for a County Contract for an Intersection and Bridge    
 Improvement at Mutec Drive (Corporate Ridge) and Woodruff Farm Road.       
 Background:  In 2005 former Governor Sonny Perdue committed funding through a    
 State Incentive Package for AFLAC Expansion Improvements up to $2,500,000.00,    
 (see attached letter).   Two projects have previously been funded using the    
 construction funding provided by the Governor  (Mutec@Aflac, completed  and    
 Cargo/Transport awarded for construction).  Funding of the Corporate    
 Ridge/Woodruff Farm Road improvements will utilize the remaining funding    
 awarded the City in the State Incentive Package.       
 Analysis:  The city of Columbus, Georgia has requested State Aid County    
 Contract with the DOT for bridge and road widening on Corporate Ridge Parkway    
 at the intersection of Woodruff Farm Road, Project No PRC10-S011-00 (685),    
 Muscogee County.   GDOT has allocated funding to the city of Columbus, Georgia    
 in a County Contract to improve the referenced project Project # PRC10-S011-00    
 (685), Muscogee County. The GDOT has pledged up to $1,022,042.67 for said    
 project.  The City may have to purchase right of way and utility re-location    
 (if necessary). Right of Way should be minimal. Three parcels are included on    
 this project. The Development Authority has controlling authority on all three    
 parcels with multiply entities that will have to sign releases. The City's    
 closing attorney has recommended that the City condemn said parcels because of    
 the complexity of obtaining all necessary releases. 	       
 Financial Considerations:  The City is responsible for items that the GDOT will    
 not pay for, such as, removal of curb and gutter, sidewalks, etc.  The City has    
 budgeted funds in CIP Project 0508-660-3000-CPPF-21035-20080 in the amount of    
 $600,000 for these anticipated expenses.         
 Projected Annual Fiscal Impact Statement:  There are no projected increase in    
 operational expenses anticipated with this project.       
 Legal Considerations:  The City Attorney disagrees with the use of Unified    
 Government when referring to the Consolidated Government throughout the    
 agreement.  The language will be modified to use Consolidated Government prior    
 to execution of the agreement.       
 Recommendations/ Actions: Approve the resolution authorizing the City Manager    
 to execute a Right of Way Agreement and subsequent agreements necessary to    
 implement this project with the Georgia Department of Transportation and the    
 City of Columbus, Georgia for a County Contract for an Intersection and Bridge    
 Improvement at Mutec Drive (Corporate Ridge) and Woodruff Farm Road, Project    
 No. PRC10-S011-00 (685).                                                   
  A RESOLUTION

 A RESOLUTION AUTHORIZING TO ENTER INTO A RIGHT OF WAY AGREEMENT WITH THE    
 DEPARTMENT OF TRANSPORTATION (GDOT) FOR A COUNTY CONTRACT FOR INTERSECTION OF    
 MUTEC DRIVE (CORPORATE RIDGE) AT WOODRUFF FARM ROAD.   
 WHEREAS, the GDOT will assist the city of Columbus, Georgia, a Consolidated    
 City/County Government, in a County Contract to improve the intersection of    
 Mutec Drive (Corporate Ridge at Woodruff Farm Road Project No. PRC10-S011-oo    
 (685), Muscogee County; and,   
 WHEREAS, a letter dated October 6, 2005 from the Governor's Office pledged    
 $2,500,000.00 of State Incentive Package for AFLAC toward DOT Road    
 Improvements; and,   
 WHEREAS,  if necessary, the City will pay for right of way and utilities    
 re-location from the CIP Fund and an account has been set up for this project;    
 and,   
 WHEREAS,  the project will extend wholly within the corporate limits of    
 Columbus, Georgia, under the laws of the state of Georgia.   
 NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:    
 That the City Manager is hereby authorized to execute a City Right of Way    
 Agreement and subsequent agreements necessary to implement the project with the    
 Georgia Department of Transportation (GDOT) for a County Contract Intersection     
 and Bridge Improvement of Mutec (Corporate Ridge) and Woodruff Farm Road,     
 Project PCR10-S011-00 (685), Muscogee County.
