SUBJECT: Fall Line Trace Easement - Calvary Free Will Baptist Church



INITIATED BY: Planning Department







Recommendation: Approval is requested to enter into an access, parking and

landscape easement agreement with the Calvary Free Will Baptist Church.



Background: Calvary Free Will Baptist has proposed that an access point

from their property to the Fall Line Trace be developed. The proposed easement

would begin at their parking lot and run to the edge of the Trace. Approval of

this agreement would allow the church to make improvements, such as benches and

other amenities, that would be within the right of way of the trail.



Analysis: The cost of any improvement, plus the installation of a path leading

from the church's parking lot to the Trace, would be the responsibility of the

church. Approval by the Parks and Recreation Department is required prior to

any improvements being made within this easement. In return the city would be

given full access to the church's parking lot for users of the trail to park.





Financial Considerations: There are no financial considerations for the City

under this agreement. All improvements will be the responsibility of the

Calvary Free Will Church.



Projected Annual Fiscal Impact Statement: No fiscal impact as a result of this

project is expected.



Legal Considerations: The City Attorney has no objections to the easement

agreement.



Recommendations/ Actions: Authorize the City Manager to enter into an access,

parking and landscape easement agreement with the Calvary Free Will Baptist

Church.















A RESOLUTION

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN ACCESS, PARKING AND

LANDSCAPING EASEMENT AGREEMENT WITH CALVARY FREE WILL BAPTIST CHURCH.

WHEREAS, Calvary Free Will Baptist Church has requested an easement to access

the Columbus Fall Line Trace from their adjacent property; and,

WHEREAS, the request would allow for a 50 foot wide easement for the purpose of

providing direct access to the Trace from the church's property; and,

WHEREAS, the agreement would allow for the placement of benches and other

landscaping amenities within this proposed easement; and,

WHEREAS, the proposed easement agreement would allow the City to utilize the

church's parking lot to provide parking and access to the Columbus Fall Line

Trace.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to enter into an Access,

Parking and Landscaping Easement Agreement with the Calvary Free Will Baptist

Church for the purpose of providing a 50 foot wide easement with trail

amenities, that would provide direct access to the Columbus Fall Line Trace.

The agreement shall also provide for access and use of the church's parking lot

by the City to provide parking for citizens using the Trace.
