A RESOLUTION GRANTING A HARDSHIP VARIANCE REQUEST TO WAIVE THE MINIMUM STREET

FRONTAGE REQUIREMENT IN ORDER TO RELIEVE LANDLOCKED LOTS AT 7565 RIVER ROAD AND

TWO ADJACENT LOTS SOUTHEAST OF SAID 7565 RIVER ROAD.



WHEREAS, Article Three of the Columbus Unified Development Ordinance

Section 7.3.5 (F.2) requires that all lots front on a minimum 25 feet of

dedicated public right-of-way or upon a right-of-way that has received the

legal status of such, except as provided for within specific zoning districts

in Section 7.4.2;



WHEREAS, applicant has requested a hardship variance to waive said

requirement pursuant to Article 3, Section 7.4.2 (A) which allows residential

developments to provide an access easement to properly satisfy street frontage

requirements when approved by the City Council on a case-by-case basis;

and,

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES:



That the criterion of Section 7.4.2(A), which provides that all lots front on a

minimum 25 feet of dedicated public right-of-way, is hereby waived. All other

Planning conditions for approval of the property located at 7565 River Road and

two adjacent lots southeast of said 7565 River Road shall remain in full force

and effect. A hardship variance to waive the street frontage requirement in

order to construct residential structures on landlocked lots is granted for the

property located at 7565 River Road and two adjacent lots southeast of said

7565 River Road.



A hardship variance is granted for the subject property with the following

condition:



1. Full disclosure of the fire safety concerns regarding hydrant distances from

the proposed landlocked lots. Said disclosure shall be placed upon any future

deed or subdivision plat of 7565 River Road and two adjacent lots southeast of

said 7565 River Road. Disclosure shall include:



a. Acknowledgement of possible inadequate water supply to property may

significantly impede or prohibit firefighting efforts.



b. Home insurance premiums may be higher due to distance from a fire hydrant.



2. Any new access easements shall be adequate for fire truck access and

turn-around ability.

14th day of April, 2015 and adopted at said meeting by the affirmative vote of

members of said Council.
