SUBJECT: Right of Way Abandonment- Portion of Reese Road
INITIATED BY: Donna W. Newman, Director of Engineering
Recommendation: Approval is requested to delete from the "Official Map of
Consolidated Government of Columbus, Georgia" an improved segment of formerly
Reese Road (Old Reese Road) between the south right of way line Milgen Road
along the eastern right of way line of Reese Road for a distance of
approximately 220 ft, declaring it surplus and authorizing its disposal in
accordance with the City Codes.
Background: There remains a portion of street that was formerly Reese Road
(Old Reese Road). Reese Road was relocated and widened in years past. This
section of roadway serves as frontage/access to 6 lots, 4 of which have been
purchased by the developer for retail development. There are existing
utilities in the area.
Analysis: The developer has requested that a portion of the right of way be
abandoned in order to construct a retail business and meet the requirements of
the UDO.
Financial Considerations: The developer has committed to construct at their
expense a public 10 ft concrete multi-purpose trail on the right of way for
Reese Road in exchange for 0.212 Ac of right of way. The developer will also
be responsible for all cost associated with abandonment and sale of the
property.
Projected Annual Fiscal Impact Statement: The City would assume maintenance of
the trail after the construction.
Legal Considerations: The Columbus Council has the sole authority to declare
the City properties and rights-of-way surplus and to approve their disposal.
Recommendations/ Actions: Approve the attached resolution deleting from the
"Official Map of Consolidated Government of Columbus, Georgia" an improved
segment of formerly Reese Road (Old Reese Road) between the south right of way
line Milgen Road along the eastern right of way line of Reese Road for a
distance of approximately 220 ft, declaring it surplus and authorizing its
disposal in accordance with the City Codes.

A RESOLUTION AUTHORIZING THE CHANGING OF THE OFFICIAL STREET AND TAX MAPS OF
THE CONSOLIDATED GOVERNMENT OF COLUMBUS, GEORGIA BY DECLARING A REMNANT SECTION
OF OLD REESE ROAD RIGHT-OF-WAY SURPLUS; THE SEGMENT OF RIGHT OF WAY BEGINNING
AT THE SOUTH RIGHT OF WAY LINE OF GENTIAN BOULEVARD AND RUNNING SOUTH ALONG THE
EAST RIGHT-OF-WAY LINE OF REESE ROAD AS DEPICTED ON A COPY OF THE SURVEY
DRAWING PREPARED BY EMC ENGINEERING SERVICES, INC. ENTITLED "RIGHT OF WAY TO BE
ACQUIRED- OLD REESE RD-RETAIL STORE" AND DATED OCTOBER 26,2016; SAID DRAWING
HIGHLIGHTING SAID RIGHT OF WAY BEING MADE PART OF THIS RESOLUTION BY REFERENCE;
PROVIDING THAT ALL EXISTING UTILITY EASEMENTS OF RECORD SHALL REMAIN IN EFFECT;
PROVIDING APPROPRIATE WIDTH OF EASEMENTS SHALL BE RESERVED AS REQUIRED BY THE
UTILITY COMPANIES SERVING ADJOINING STREETS AND PROPERTIES BY THE UTILITY
COMPANIES FOR UNKNOWN UTILITIES; AUTHORIZING THE DISPOSAL OF SAID RIGHT-OF-WAY
IN ACCORDANCE WITH COLUMBUS CHARTER ; AND FOR OTHER PURPOSES.
WHEREAS, the right-of-way is no longer needed for public use; and,
WHEREAS, the developer has committed to construct at their expense a
multi-purpose trail in exchange for the right-of -way.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
SECTION I.
That the "Official Street Map of the Consolidated Government of
Columbus, Georgia" maintained in accordance with Section 18.1 of the Columbus
Code and appropriate Tax Maps are hereby amended by deleting the following
segment of Old Reese Road:
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING SITUATE IN LAND LOT 27
OF THE EIGHTH LAND DISTRICT, COUNTY OF MUSCOGEE AND CITY OF COLUMBUS, IN THE
STATE OF GEORGIA; AND BEING KNOWN AND DISTINGUISHED AS PARTS OF LOTS 3 & 4,
SUBDIVISION OF THE S.B. HATCHER TRACT, M.M. MASSEY PLACE, AS THE SAME APPEARS
UPON A MAP OR PLAT OF SAID SUBDIVISION RECORDED IN PLAT BOOK 16, FOLIO 17, IN
THE OFFICE OF THE CLERK OF SUPERIOR COURT OF MUSCOGEE COUNTY, GEORGIA, AND
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCE AT A CONCRETE MONUMENT FOUND AT THE INTERSECTION OF THE NORTHWESTERLY
RIGHT-OF-WAY LINE OF GENTIAN BOULEVARD (80' PUBLIC RIGHT-OF-WAY) (FORMERLY
KNOWN AS TALBOTTON ROAD) WITH THE NORTHEASTERLY RIGHT-OF-WAY LINE OF OLD REESE
ROAD (40' PUBLIC RIGHT-OF-WAY) (FORMERLY KNOWN AS "40' ROAD") AND THENCE GO
ALONG THE NORTHEASTERLY RIGHT-OF-WAY LINE OF OLD REESE ROAD NORTH 39 DEGREES,
17 MINUTES, 57 SECONDS WEST FOR A DISTANCE OF 5.05 FEET TO A POINT ON SAID
NORTHEASTERLY RIGHT-OF-WAY LINE OF OLD REESE ROAD, SAID POINT BEING THE POINT
OF BEGINNING.
FROM SAID POINT OF BEGINNING, THENCE GO NORTH 84 DEGREES, 56 MINUTES, 37
SECONDS WEST FOR A DISTANCE OF 55.94 FEET TO A POINT; THENCE GO NORTH 39
DEGREES, 17 MINUTES, 57 SECONDS WEST FOR A DISTANCE OF 11.46 FEET TO A POINT;

SAID TRACT CONTAINS 0.178 ACRES ~ 7,770 Sq. Ft.
SECTION II.
That the segment of right-of-way described here within Section I is no
longer needed for roadway purposes. Said segment of right-of-way is hereby
declared surplus and authorized for disposal by the City Manager is accordance
with the Columbus Charter.
SECTION III.
That all existing utility easements of record shall remain in effect
and providing appropriate width easements shall be reserved as required by the
utility companies serving adjoining streets and properties for unknown
utilities.
