BOARD OF ZONING APPEALS
REGULAR MEETING - 2:00 P.M. ? August 5, 2009
The Regular Meeting of the Board of Zoning Appeals was held Wednesday, August
5, 2009, at 2:00 P.M., on the First Floor of the Columbus Consolidated
Government Annex Building located at 420 10th Street.

Also present representing the Inspections and Code Enforcement Department were
Danny Cargill, Secretary of the Board, and Ms. Jacqueline Goodwin, Acting
Recording Secretary.
Call To Order:
The meeting was called to order at 2:00 p.m. by Mr. Wright Wade, Board
Chairperson.
VARIANCE APPEALS:
CASE NO. 09-V051--GRANTED
Ms. Marilyn Woods appeared before the Board to request a variance from the
zoning ordinance for 216 26th Street, to reduce the rear yard setback
requirement from 30 feet to 13 feet shown, in order to add a porch to the
existing single family dwelling. The property is zoned SFR4.
Ms. Woods stated that it will be an open porch, not screened around.
Mr. Wade asked if the water will be running the same direction coming, off the
roof as it does now, according to the roof elevation.
Ms. Woods replied that the water will be in the same direction, and that the
water runs to the rear.
Mr. Wade asked if there had been any problems with the neighbors of the water
running on their property.
Mr. Brinegar asked if there was a house behind her house.
Ms. Woods replied that there have not been any problems with the neighbors, and
there is not a house situated behind her house. It is an empty lot.
There was no opposition present for this appeal.
Mr. Borom motion to grant the request based on no opposition, and that behind
her home was an empty lot. Mr. Hart seconded the motion. The motion was
carried unanimously.
CASE NO. 09-V052--GRANTED
Mrs. Susan Connery and Sia Etemadi appeared before the Board to request a
variance from the zoning ordinance for 502 Broadway, to reduce the corner side
yard setback requirement from 20 feet to 14 feet shown, and increase the height
requirement from 14 feet to 18 feet shown, in order to erect a detached
garage. The property is zoned Historic.
Mrs. Connery stated that she wants to build a two car garage and an office
upstairs, which is why she is requesting the additional height. It has been
approved by the Board of Historic and Architectural Review Board.
Mr. Cargill stated that the appeal was for the setbacks and height increase,
and a home occupation for use as an office is not allowed in a detached
structure.
Mr. Etemadi explained that originally the height requirement was for storage,
and Mrs. Connery stated that she might put an office on the second floor. They
need a second floor.
Mr. Cargill further stated that the second floor is permitted, as long as Mrs.
Connery understands that an office is not allowed in a detached structure. A
business can not be conducted in the accessory structure.
Mr. Etemadi further explained that Mrs. Connery needed space, and that she has
an office in her home.
There was no opposition present for this appeal.
Mr. Hart motion to grant the request, based on the fact that the garage had
been approved by the Board of Historic and Architectural Review, business will
not be conducted in the detached structure, and that there was no opposition.
Mr. Borom seconded the motion. The motion was carried unanimously.
CASE NO. 09-V053--GRANTED
Mr. Jimmy Weaver, A-Airflow Awning, on behalf of Mr. Joseph Norman, appeared
before the Board to request a variance from the zoning ordinance for 2800
Walker Street, to reduce the side yard setback requirement from 8 feet to 1
foot shown, and reduce the front yard setback requirement from 25 feet to 16
feet shown, in order to add a 20? x 24? carport to the existing single family
dwelling. The property is zoned SFR3.
Mr. Weaver stated that Mr. Norman is requesting a double carport, as shown in
the pictures. It will be guttered on both sides, and the water will run to the
street, the same way it does now. The neighbors have a patio cover on the
right hand side that is on the property line.
Mr. Wade asked in reviewing the slope of the existing roof, will the carport be
tied into it.
Mr. Weaver replied that the carport will be tied to the existing roof, which
will be a gable type carport.
There was no opposition present for this appeal.
Mr. Borom motion to grant the request, based on the fact that at least 1 ? foot
variance, and the waterflow should not change and it is consistent with the
neighborhood. Also, there was no opposition. Mr. Hart seconded the motion. Mr.
Wade commented that Mr. Weaver stated that it would be guttered and the water
would go on the existing concrete pad and flow to the street. The motion was
carried unanimously.
CASE NO. 09-V054?GRANTED
Ms. Rebecca Toole, on ServiceMaster Clean, appeared before the Board to request
a variance from the zoning ordinance for 1927 13th Street, to increase the
height requirement from 14 feet required to 17 feet shown, in order to erect a
garage. The property is zoned RMF2.
Mrs. Toole stated that we would like to rebuild the garage closer to the way it
originally was built with a gable roof, that would have a bonus room above.
Therefore, we would need the height for the room. The garage with bonus room
has been approved by the Board of Historic and Architectural Review.
There was no opposition present for this appeal.
Mr. Borom motion to grant the request, based on the fact that it is consistent
with the older structure, and approved by the Board of Historic and
Architectural Review. Also, there was no opposition. Mr. Hart seconded the
motion. The motion was carried unanimously.
TABLED FROM JULY 1, 2009
CASE NO. 09-V047--GRANTED
Mr. Ray Underwood, on behalf of Mr. Jorge Orderique, appeared before the Board
to request for a variance from the zoning ordinance for 2361 South Lumpkin
Road, to reduce the number of parking spaces from 21 spaces allowed to 17
spaces shown. The property is zoned NC.
Mr. Ray Underwood stated that Mr. Orderique has a small convenience store with
a small restaurant inside. He has more than enough parking spaces for the
small site.
Mr. Hart asked what would be done if he needed an overflow of parking.
Mr. Underwood replied that they could park on the street, or a side street.
There is also a gas station across the street.
Mr. Wade asked particular of Wise Street. There looks like plenty of right of
way for parking on Wise Street.
Mr. Hart asked about the adjacent property.
Mr. Underwood stated there is a gas station on the opposite, and residential
property.
Mr. Wade stated that if they don?t have enough parking, and the people can?t
buy anything, that will be Mr. Orderique?s problem.
There was no opposition present for this appeal.
Mr. Hart motion to grant the request based on the fact that they are only
asking for the reduction of four parking spaces, and if needed, they can have
those spaces on Wise Street. Also there was no opposition to their appeal.
Mr. Brinegar seconded the motion. The motion was carried unanimously.
MINUTES OF THE LAST MEETING:
The minutes of the regular meeting of July 1, 2009 was presented for approval
as written.
Mr. Borom moved to accept the minutes of the regular meeting of July 1, 2009.
The motion was seconded by Mr. Hart and carried unanimously.
ADJOURNMENT:
There being no further business to come before the Board, the meeting adjourned
at 2:35 p.m.
