SUBJECT: Acceptance of Property - PAWS Columbus, Inc.

Recommendation: Approval is requested for the acceptance of a transfer of
property lying in a part of Land Lots 6 & 7, 8th District, 2.420 +/-Acres (see
attached plat) from the PAWS Columbus, INC., a nonprofit corporation organized
and existing under the laws of the State of Georgia (?PAWS?) to the City of
Columbus.
Background: The citizens of Columbus voted in 1999 to approve a Special
Purpose Local Option Sales Tax (SPLOST) that included an authorization for the
expenditure from the special sales and use tax thereby imposed in the sum of
$2,000,000 for construction of a new Animal Control facility. PAWS has
acquired approximately 11.824 acres of real property in the Cooper Creek/Milgen
Road area located in parts of Land Lots 6 and 7, 8th District, Columbus,
Muscogee County, Georgia. A portion is proposed to be developed as an animal
resource campus, which will consists of the Animal Care and Control facility to
be operated by the City and an Animal Resource Center to be operated by PAWS.
Analysis: The transfer of property is in accordance with the Memorandum of
Understanding between PAWS Columbus, Inc., and the City dated July 21, 2006.
PAWS is to convey to the City a portion of the 11.824 acres for the Animal Care
and Control facility to be operated by the City. The 2.420 +/- acres of
property has been identified as the proposed site for the Animal Care and
Control facility. PAWS will retain the remaining portion of the property to
build the PAWS facility.
Financial Considerations: PAWS Columbus, Inc., will transfer said
property to the City by Warranty Deed, with all encumbrances and liens being
paid by PAWS.
Legal Considerations: Council must approve acceptance of property in
accordance with Columbus Charter.
Recommendations: Approve the attached Resolution approving the acceptance of
the above-identified property.

A RESOLUTION AUTHORIZING ACCEPTANCE OF PROPERTY LYING IN A PART OF LAND LOTS 6
& 7, 8TH DISTRICT, 2.420 +/-ACRES (SEE ATTACHED PLAT), FROM THE PAWS COLUMBUS,
INC., A NONPROFIT CORPORATION ORGANIZED AND EXISTING UNDER THE LAWS OF THE
STATE OF GEORGIA (?PAWS?), TO THE CITY OF COLUMBUS.
WHEREAS, the citizens of Columbus voted in 1999 to approve a Special Purpose
Local Option Sales Tax (SPLOST) that included an authorization for the
expenditure from the special sales and use tax thereby imposed in the sum of
$2,000,000 for construction of a new animal control facility; and,
WHEREAS, PAWS has acquired approximately 11.824 acres of real property in the
Cooper Creek/Milgen Road area located in parts of Land Lots 6 and 7, 8th
District, Columbus, Muscogee County, Georgia (the ?Property?) on a portion of
which is proposed to be developed as an animal resource campus which will
consists of the animal care and control facility to be operated by the City
(the ?ACC Facility) and a portion will be an animal resource center to be
operated by PAWS for the furtherance of the purposes of PAWS (the ?PAWS
Facility?); and,
WHEREAS, the transfer of property is in accordance with the Memorandum of
Understanding between PAWS and the City dated July 21, 2006; and,
WHEREAS, the above described 2.420 +/- acres of property has been identified as
the proposed site for the Animal Care and Control facility to be operated by
the City; and,
WHEREAS, the property is available for transfer from PAWS Columbus, Inc., a
nonprofit corporation organized and existing under the laws of the state of
Georgia (?Paws?), to the city of Columbus; and,
WHEREAS, it is in the best interest of the Consolidated Government of Columbus,
Georgia to accept the transfer of the property.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to:
1. Accept transfer of property identified as property lying in a part
of land lots 6 & 7, 8th district, 2.420 +/-acres (see attached plat), from the
PAWS Columbus, Inc., a nonprofit corporation organized and existing under the
laws of the State of Georgia (?PAWS?); and,
2. File the Warranty Deed with Superior Court Clerk for permanent
record.
Introduced at a regular meeting of the Council of Columbus, Georgia,
held the _____day of _________, and adopted at said meeting by the affirmative
vote of _____members of said Council.
