SUBJECT: Probation Services Contract



INITIATED BY: City Manager?s Office



Recommendation: Approval is requested to amend the contract with for

the with Georgia Probation Services, Inc., to increase probation supervision

fees from $30 to $35 per month for regular probation supervision and from $50

to $55 for intensive probation supervision for misdemeanor offenses for the

Superior Court and Municipal Court.



Background: In 1992 the Official Code of Georgia, 42-8-100, provided a

process for establishment of agreements between chief judges of county courts

and corporations, enterprises, or agencies for probation services. This law

provided that the chief judge of any court within the county, with the approval

of the governing authority of that county, is authorized to enter into

memoranda of agreement or other written documents evidencing contracts with

corporations, enterprises, or agencies, or to establish a county probation

system.



Analysis: The Courts and Georgia Probation Services, Inc., entered into an

agreement for probation services on March 7, 1997 Resolution #199-97. Both

parties agree that inflation since the date of the original agreement justifies

increases in monthly probation supervision fees and that provision should be

made for future adjustments of said probation fees to keep pace with inflation.



Financial Considerations: The cost associated with the proposed amendment will

be passed on to individuals placed on probation. The City will not realize any

revenue or incur any expenditure from this program.



Legal Considerations: The law authorized the judges to enter into the contract

with the approval of the governing authority. The Council by approving these

contracts will comply with the requirements under the law of the judges to

contract with Georgia Probation Services.



Recommendations/ Actions: Approval is requested to amend the probation service

contract with Georgia Probation Services.
