An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at 1323 11th Avenue from GC (General Commercial) District to LMI (Light

Manufacturing / Industrial) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from GC (General

Commercial) District to LMI (Light Manufacturing / Industrial) District:



All that tract or parcel of land lying in Land Lots 12 & 13, Coweta Reserve,

and being Parcel A & B of the Howard Survey, Part of Lots 36, 37 & 38 of the

Howard Survey, Columbus, Muscogee County, Georgia, and being more particularly

described as follows:



BEGINNING at a drill hole marking the intersection of the Northern Right of Way

line of 13th Street, said right of way being 80 feet, with the Western Right of

Way line of 11th Avenue, said right of way being 45 feet, from said POINT OF

BEGINNING thus established, South 87 degrees 39 minutes 33 seconds West along

the northern Right of Way of 13th Street, said Right of Way being 80 feet, for

a distance of 280.51 feet to a drill hole in concrete marking the intersection

of the Northern Right of Way line of 13th Street with the Eastern Right of Way

line of Webster Avenue; THENCE along the Eastern Right of Way of Webster Avenue

North 01 degrees 34 minutes 47 seconds West for a distance of 424.07 feet to a

3/4? crimped top pipe; THENCE continue along said Right of Way line North 01

degrees 42 minutes 36 seconds West for a distance of 152.16 feet to a drill

hole in concrete; THENCE North 01 degrees 37 minutes 39 seconds West for a

distance of 150.72 feet to a 1? crimped pipe marking the intersection of the

Southern Right of Way line of 14th Street with the Eastern Right of Way line of

Webster Avenue; THENCE along the Southern Right of Way line of 14th Street,

said Right of Way being 50 feet, North 88 degrees 02 minutes 58 seconds East

for a distance of 155.20 feet to a drill hole in concrete; THENCE continue

along said Right of Way North 88 degrees 02 minutes 10 seconds East for a

distance of 123.63 feet to a Nail & Cap, said nail and cap marking the

intersection of the Southern Right of Way line of 14th Street with the Western

Right of Way line of 11th Avenue, said 11th Avenue right of way being 45 feet;

THENCE along said Right of Way South 01 degrees 47 minutes 10 seconds East for

a distance of 79.96 feet to a 3/4 ? crimped top pipe; THENCE continue along

said Right of Way South 01 degrees 44 minutes 57 seconds East for a distance of

132.78 feet to a drill hole in concrete; THENCE continue along said Right of

Way South 01 degrees 44 minutes 35 seconds East for a distance of 512.62 feet

to a drill hole in concrete and the TRUE POINT OF BEGINNING.



Said tract or parcel of land is shown as Parcel 3, containing 4.66 acres, on

that certain map or plat of survey entitled ?ALTA/ASCM Land Title Survey for

Hallmark Cards, Inc. and Common Weather Land Title Insurance Company, Lying

within Land Lots 12, 13, 39 & 40, Coweta Reserve, Columbus, Muscogee County,

Georgia prepared by Jordan, Jones & Goulding, Registered Land Surveyor #2775,

being dated July 10, 2002.



Said tract or parcel of land described therein is conveyed subject to all

covenants, easements and restrictions of record.



LESS AND EXCEPT:



All that lot, tract, or parcel of land situate, lying, and being in Land Lot

12, Coweta Reserve,Columbus, Muscogee County, Georgia, as same was conveyed

under Corrective Limited Warranty Deed from Litho-Krome Company to S.L.

Buracker Holdings, LLC dated October 18, 2002, and recorded in Deed Book 6557,

Page 106, aforesaid Clerk?s office, said property being more particularly

described as follows:

Begin at the intersection of the southerly margin of the right of way of 14th

Street (a 50 foot right of way) with the westerly margin of the right of way of

11th Avenue (a 45 foot right of way) marked by a nail and cap and being the

POINT OF BEGINNING; thence along the westerly margin of 11th Avenue running

South 01 degree 47 minutes 10 seconds East a distance of 79.96 feet to a ??

crimp top pipe located on the westerly margin of said right of way; thence

leaving said

right of way running South 88 degrees 02 minutes 06 seconds West a distance of

124.30 feet to a ?? crimp top pipe; thence running North 01 degree 18 minutes

16 seconds West a distance of 79.97 feet to a drill hole located on the

southerly margin of the right of way of 14th Street; thence along the southerly

margin of the right of way of 14th Street running North 88 degrees 02 minutes

10 seconds East a distance of 123.63 feet to the POINT OF BEGINNING.



The above described property is designated as Parcel B on that certain map or

plat of survey entitled Boundary Survey, Parcel B Part of Howard Survey, Lying

within Land Lot 12, Coweta Reserve, Columbus, Muscogee County, Georgia for

Judith Whittaker, General Counsel, Litho-Krome Company & Samuel L. Buracker,

III, dated August 5, 2002, prepared by Jordan, Jones & Goulding, Said survey is

made a part hereof by this reference for a more particular description of the

location and dimensions of said property.



AND



All that lot, tract or parcel of Land Lying in Land Lot 12, Coweta Reserve,

Columbus, Muscogee County, Georgia, as same was conveyed under Warranty Deed

from Lithro-Krome Company to Cargill Development, LLC, dated May 23, 2003 and

recorded in Deed book 6860, page 67, aforesaid Clerk?s office, as said property

is shown and depicted as ?0.47 acres +/- (20,535 S.F.)? on that certain map or

plat entitled ?Boundary Survey, Part of Howard Survey, Lying in Land Lot 12,

Coweta Reserve, Columbus, Muscogee County, Georgia for Litho-Krome Company,

Cargill Development Judith Whittaker, General Counsel, prepared by Jordan,

Jones & Goulding, Mitchell J. Paulk, Ga RLS #2775, dated April 28, 2003,

recorded in Plat Book 149, Folio 7, in the office of the Clerk of Superior

Court of Muscogee County, Georgia, to which reference is hereby made for a more

particular metes and bounds description of said property.



AND



All that lot, tract or parcel of land situate, lying and being in Columbus,

Muscogee County, Georgia, as same was conveyed under Warranty Deed from

Litho-Krome Company to Dixie Investments, LLC, dated November 10, 2005, and

recorded in Deed book 8170, Page 254, aforesaid Clerk?s office, and as said

property is described in said warranty deed as being known and designates as

?Lot 300? on that certain map or plat of survey ?REPLAT OF PART OF HOWARD

SURVEY, COLUMBUS, MUSCOGEE COUNTY, GEORGIA?, dated October 19, 2005, prepared

by Moon, Meeks, Mason, & Vinson, Inc., recorded in Plat Book 155, Page 119, in

the Office of the Clerk of Superior Court of Muscogee County, Georgia.



The above-described property is being rezoned with the following condition:



1. All buffer requirements shall be waived for this property.

held on the 13th day of June, 2006; introduced a second time at a regular

meeting of said Council held on the day of ___ , 2006
