SUBJECT: Quitclaim Deed from Uptown to City of Columbus



INITIATED BY: Laura McCool, Community Reinvestment Division Manager



Recommendation: Approval is requested to accept a Quitclaim Deed recorded at

deed book 10936, Page 336 to add the proper legal description to the Eagle &

Phenix Power Houses and the Access Easement. The property is located around the

power house structures and along the riverbed utilized as a temporary access

road that leads to the power houses per the attached plats.



Background: In May 2013, the property was deeded to Columbus Consolidated

Government from Uptown Riverbed, LLC and Eagle & Phenix Hydro Company, Inc. via

a Quitclaim Deed. At the time there were no plats to coincide with the deed and

the legal description was not defined. Moon, Meeks, Mason & Vinson re-platted

the property to identify the metes and bounds, and these plats are incorporated

into the Quitclaim Deed. The deed also incorporates an access easement along

the access road on the riverbed to allow for ingress, egress, maintenance and

utilities to the power- houses.



Analysis: Incorporating the plats into the Quitclaim Deed will provide a better

legal description of the property. It will also incorporate the easements

needed for the development of the power houses.



Financial Considerations: This is an addition to a deed. There will be no

financial impact on the City.



Legal Considerations: Council must approve changes to quitclaim deeds involving

City property.



Recommendations/ Actions: Approve the City Manager to accept a Quitclaim Deed

from Uptown Riverbed, LLC and Eagle & Phenix Hydro Company, Inc. to add the

proper legal description to the Eagle & Phenix Power Houses and the Access

Easement. The property is located around the power house structures and along

the riverbed utilized as a temporary access road that leads to the power houses

per the attached plats.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ACCEPT A QUITCLAIM DEED FROM

UPTOWN RIVERBED, LLC AND EAGLE & PHENIX HYDRO COMPANY, INC. FOR THE PROPERTY

LOCATED AROUND THE POWER HOUSE STRUCTURES AND AN ACCESS EASEMENT.



WHEREAS, Uptown Columbus Inc. has requested authorization and execution of a

Quitclaim Deed to accept the deed recorded at deed book 10936, Page 336 so as

to reflect the proper legal description to the Eagle & Phenix Power Houses and

the Access Easement to the same; and,



WHEREAS, a draft quitclaim deed has been prepared and is attached hereto as

Exhibit A; and,



WHEREAS, plats have been prepared to provide a better legal description of the

properties and to identify the access easement are attached hereto as Exhibits

B & C; and,



WHEREAS, the execution and delivery of said corrective quitclaim deed to the

City is in the best interests of the City and Uptown.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:



That the City Manager is hereby authorized to execute the attached Quitclaim

Deed, concerning the above described property.
