An Ordinance amending the Zoning Atlas of the Consolidated Government of

Columbus, Georgia; this amendment changes certain boundaries of a district

located at the Southwest corner of 9601 Yellow Pine Road (Garrett Pines

subdivision) and the Northwest corner of 8997 Macon Road (proposed Midland

Downs development) from SFR3 (Single Family Residential 3) to PMUD (Planned

Mixed Unit Development) Zoning District for the Southwest Corner of 9601 Yellow

Pine Road from and from PMUD (Planned Mixed Unit Development) to SFR3 (Single

Family Residential 3) Zoning District for the Northwest Corner of 8997 Macon

Road.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Department be, and the

same is hereby amended by changing the aforementioned property of the following

described property from SFR3 (Single Family Residential 3) to PMUD (Planned

Mixed Unit Development) Zoning District for the Southwest Corner of 9601 Yellow

Pine Road from and from PMUD (Planned Mixed Unit Development) to SFR3 (Single

Family Residential 3) Zoning District for the Northwest Corner of 8997 Macon

Road:



All that tract or parcel of land lying in and being part of Land Lot 130, 9th

District, Columbus, Muscogee County, Georgia shown as Parcel A on a rezoning

plat, dated 19 March 2012, prepared by Moon, Meeks, Mason & Vinson, Inc. and

more particularly described as follows: Commence at an iron stake marking the

intersection of the southerly line of Yellow Pine Road and the southeasterly

line of Yarbrough Road; thence southwesterly along the southeasterly line of

Yarbrough Road, 496.34 feet to an iron stake; thence leaving said road South 73

degrees 13 minutes 00 seconds East, 13.72 feet to an iron stake at the POINT OF

BEGINNING; continuing South 73 degrees 13 minutes 00 seconds East, 174.33 feet

to an iron stake; thence South 54 degrees 18 minutes 47 seconds West, 210.79

feet to an iron stake, thence South 23 degrees 44 minutes 16 seconds East,

147.87 feet to an iron stake; thence South 66 Degrees 15 minutes 44 seconds

West, 114.71 feet to an iron stake on the southerly line of Land Lot 130;

thence South 88 degrees 02 minutes 00 seconds West, along the southerly line of

Land Lot 130, 74.95 feet to an iron stake; thence leaving said Land Lot line,

North 12 degrees 58 minutes 57 seconds West, 319.22 feet to an iron stake;

thence North 87 degrees 25 minutes 08 seconds East, 50.0 feet to an iron stake;

thence easterly and northeasterly along the arc of a counterclockwise curve

(said arc having a radius of 310.21 feet and being subtended by a 152.95 foot

chord bearing North 73 degrees 14 minutes 33 seconds East) , 154.55 feet to an

iron stake at the point of beginning; containing 1.610 acres.

All that tract or parcel of land lying in and being part of Land Lots 130 and

159, 9th District, Columbus, Muscogee County, Georgia shown as Parcel B on a

rezoning plat, dated 19 March 2012, prepared by Moon, Meeks, Mason &. Vinson,

Inc. and more particularly described as follows: Commence at an iron stake

marking the intersection of the southerly line of Yellow Pine Road and the

southeasterly line of Yarbrough Road; thence southwesterly along the

southeasterly line of Yarbrough Road, 496.34 feet to an iron stake; thence

leaving said road South 73 degrees 13 minutes 00 seconds East, 188.05 feet to

an iron stake at the POINT OF BEGINNING; thence North 36 degrees 25 minutes 24

seconds East, 293.91 feet to an iron stake; thence North 70 degrees 12 minutes

46 seconds East, 118.61 feet to an iron stake; thence South 76 degrees 18

minutes 18 seconds East, 125.01 feet to an iron stake; thence North 87 degrees

25 minutes 08 seconds East, 42.28 feet to an iron stake; thence South 33

degrees 40 minutes 00 seconds WestJ384.83 feet to an iron stake; thence North

73 degrees 13 minutes 00 seconds West, 247.0 feet to an iron stake and the

point of beginning; containing 1.860 acres.



The above-described properties are being rezoned subject to the following

conditions:



1. Reduce the required minimum rear perimeter buffer from 100 feet to 0 feet

because proposed single family residential lots will be abutting proposed

single family residential lots in the adjoining Garrett Pines subdivision.

2. Smoke and noise disclosure statements shall be included in closing

information on real estate business or leases.

day of June, 2012; introduced a second time at a regular meeting of said
