SUBJECT: Quit Claim of Algonquin Drive from Muscogee County School
District
INITIATED BY: David Arrington, Deputy City Manager
Recommendation: Approval is requested to accept a Quit Claim Deed from the
Muscogee County School District for a portion of Algonquin Drive.
Background: In Resolution 173-09 Council approved the conveyance of
Algonquin Drive and Cougar Court to the Board of Regents of the University
System of Georgia. During the title search conducted as part of the conveyance
process it was determined that a section of Algonquin Drive, approximately 500
ft. as shown in Plat Book 29, was the property of the Muscogee County School
District (MCSD). The School District is preparing a Quit Claim Deed for this
property to the City in order for the property to ultimately be conveyed to the
Board of Regents for the purpose of becoming a part of the Columbus State
University campus.
Analysis: It is mutually beneficial to the City and Columbus State University
(CSU) for both Algonquin Drive and Cougar Court to be a part of the CSU
campus. The streets are primarily utilized by the university for internal
circulation and have a high volume of pedestrian traffic. The agreement
previously approved by Council can not be fully executed without the section of
Algonquin Drive currently owned by the MCSD. All parties are in agreement with
the City accepting the property from MCSD and then transferring both Algonquin
Drive and Cougar Court to the Board of Regents. Representatives from the Board
of Regents have expressed an interest in presenting this matter for approval at
the October meeting of the Board of Regents. The City is prepared to execute
all legal documents to facilitate the transfer, with the approval of Council,
to accept this small section of Algonquin from MCSD.
Financial Considerations: There are no financial considerations with this
request.
Projected Annual Fiscal Impact Statement: The City will be relieved of all
maintenance responsibilities and liabilities associated with these streets upon
acceptance by the Board of Regents.
Legal Considerations: Council must approve the acceptance of the Quit Claim
Deed.
Recommendations/ Actions: Authorize the City Manager to accept a Quit Claim
Deed from the Muscogee County School District for a portion of Algonquin Drive.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A QUIT CLAIM DEED FROM THE
MUSCOGEE COUNTY SCHOOL DISTRICT FOR A PORTION OF ALGONQUIN DRIVE.
WHEREAS, in Resolution #173-09 Council approved a Memorandum of Understanding
with Columbus State University and Board of Regents of the University System of
Georgia for the conveyance of Algonquin Drive and Cougar Court to the Board of
Regents of the University System of Georgia; and,
WHEREAS, a title search of the property determined that a section of Algonquin
Drive, approximately 500 ft. in length, was owned by the Muscogee County School
District; and,
WHEREAS, the Muscogee County School District is willing to Quit Claim the said
street segment to the City for the specific purpose of the property being
conveyed to the Board of Regents for part of the Columbus State University
Campus; and,
WHEREAS, the City will be relieved of all maintenance responsibilities and
liabilities associated with these streets upon acceptance by the Board of
Regents; and,
WHEREAS, the acceptance of the Algonquin Drive street segment from the School
District is necessary to complete the terms of the Memorandum of Understanding
approved by Council in Resolution #172-09.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
THAT HE CITY MANAGER IS HEREBY AUTHORIZE TO EXECUTE A QUIT CLAIM DEED
FROM THE MUSCOGEE COUNTY SCHOOL DISTRICT FOR A PORTION OF ALGONQUIN DRIVE.
