SUBJECT: Access Easement for 16 11th Street



INITIATED BY: Community Reinvestment Division





Recommendation: Approval is requested to grant an easement for use, access and

construction to Neighborworks Columbus, located at 18 11th Street, onto the

property located at 16 11th Street, Columbus, Muscogee County, Georgia.



Background: Neighborworks Columbus desires an access easement onto 16 11th

Street to construct, replace, remove, maintain or modify the rear of their

building by installing a door exiting the south wall of the building, and

constructing a deck on the southeast corner of the building per the attached

plat. When MaBella's, located at 14 11th Street, put in their freezer, it

created an issue for Neighborworks Columbus to safely get out of their

building. Providing Neighborworks Columbus with an easement to make the

necessary modifications to their building will correct this safety concern.



Analysis: Neighborworks Columbus shall be solely responsible for all costs

related to any construction or maintenance activities it undertakes related to

the easement at no cost to the City. The easement will not interfere with the

current use of the property.



Financial Considerations: There is no financial obligation for the City.



Legal Considerations: The granting of an easement on City property to

Neighborworks Columbus requires the approval of Council.



Recommendations/ Actions: Approve the Resolution authorizing the City Manager

to grant an easement for use, access and construction to Neighborworks

Columbus, located at 18 11th Street, onto the property located at 16 11th

Street, Columbus, Muscogee County, Georgia.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO GRANT AN EASEMENT FOR USE, ACCESS

AND CONSTRUCTION TO NEIGHBORWORKS COLUMBUS ONTO THE PROPERTY LOCATED AT 16 11TH

STREET, COLUMBUS, MUSCOGEE COUNTY, GEORGIA.



WHEREAS, Neighborworks Columbus approached the City to request an

easement onto 16 11th Street for use, access and construction; and,



WHEREAS, the easement is needed to correct a safety concern with

exiting the rear of their building located at 18 11th Street; and,



WHEREAS, the easement will be granted to construct, replace, remove,

maintain or modify the rear of their building by installing a door exiting the

south wall of the building, and constructing a deck on the southeast corner of

their building; and,



WHEREAS, Neighborworks Columbus shall be solely responsible for all

costs related to any construction or maintenance activities it undertakes

related to the easement at no cost to the City; and,



WHEREAS, granting of an easement will not interfere with the current

use of the property.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:



That the City Manager is hereby authorized to grant an easement to

Neighborworks Columbus for use, access and construction onto the property

located at 16 11th Street, Columbus, Muscogee County, Georgia

Introduced at a regular meeting of the Council of Columbus, Georgia,

held the _________ day of _____________, 2016 and adopted at said meeting by

the affirmative vote of ____________ members of said Council.
