BOARD OF ZONING APPEALS
REGULAR MEETING - 2:00 P.M. ? OCTOBER 3, 2007
The Regular Meeting of the Board of Zoning Appeals was held Wednesday, October
3, 2007 at 2:00 P.M., on the 1st Floor of the Government Center Annex in the
conference room, 420-10th Street. Mr. Billy Edwards, Board Chairman, called
the meeting to order. The board members present were:
Mr. Ralph King
Mr. Perry Borom
Mr. Wright Wade
Mr. Willie Lewis, Jr.
Also present representing the Inspections and Code Enforcement Department was
Mr. Kevin Simms, representing the Secretary of the Board, Mrs. Millicent
Burden, Recording Secretary and Mr. Will Johnson from the Planning
Department.
CASE NO. 07-V080?GRANTED
David Cummings for Wright Wade, 908 2nd Avenue, to reduce the side setback
requirements from 12 ft to 2 ft for an addition. The property is zoned UPT.
Mr. Wright Wade excused himself from the room due to a conflict of interest.
Mr. Cummings stated that they?ve worked very hard with the Uptown Facade Board
to ensure that they were in compliance. The existing building sits at 2 ft
already and they would like to add to it. They have gutters that catch the
water runoff.
There was no opposition present for this appeal.
Mr. King made a motion to grant this appeal. Mr. Borom seconded the motion.
Motion carried unanimously.
CASE NO. 07-V081--GRANTED
Jimmy Weaver of A-Airflow Awning Co., 3901 Trask Drive, to reduce the side yard
setback requirement from 8 ft to 5 ft; and to reduce the front yard setback
requirement from 25 ft to 23 ft to erect a carport. The property is zoned SFR3.
Mr. Weaver stated that the homeowner is wheel chaired bound and he needs a
carport so that it will protect him from the elements as he enters and exits.
The water will run off to the front of the street. He presented pictures of
two of his neighbors that have pre-existing carports that are similar.
There was no opposition present for this appeal.
Mr. Wade made a motion to grant this appeal. Mr. Lewis seconded the motion.
Motion carried unanimously.
CASE NO. 07-V082?GRANTED
Scott McGregor of Aquarius Pools Construction Co., 7015 Feldspar Court, to
allow an accessory structure in the side yard. The property is zoned SFR3.
Mr. McGregor stated that the pool is actually behind the house on the corner,
but with the addition, it makes the house line a little further back. The
topography causes the hardship of placing it on the side of the home.
There was no opposition present for this appeal
Mr. Wade made a motion to grant this appeal. Mr. Borom seconded the motion.
Motion carried unanimously.
CASE NO. 07-V083--GRANTED
Scott McGregor of Aquarius Pools Construction Co., 7457 Rolling Bend Court, to
allow an accessory structure in the front yard. The property is zoned SFR1.
Mr. McGregor stated that the house is directly behind the house but the way the
house sits on the property is odd. The house actually faces the rear of the
lot. Placing the pool in this location, you won?t actually be able to view it
from either side of the house.
There was no opposition present for this appeal.
Mr. Wade made a motion to grant this appeal. Mr. Lewis seconded the motion.
Motion carried unanimously.
CASE NO. 07-V084?WITHDRAWN
Rob McKenna of The Hitesan Co., 4617 Armour Road, to reduce the side yard
setback requirement from 12 ft to 2 ft for an addition. The property is zoned
NC.
CASE NO. 07-V085?GRANTED
Robert Teasley of Signs Inc., 5870 Veterans Parkway, to increase the number of
signs allowed from 1 to 2; and to increase the area of a sign from 250 square
ft to 375 square ft. The property is zoned GC.
Mr. Teasley stated that there was an Amoco that applied for a previous variance
and was approved, but when they moved, the pole was removed. When the new
tenant moved in, they didn?t have a pole to put up a sign. This will be a
separate sign for the new business.
There was no opposition present for this appeal
Mr. King made a motion to grant this appeal. Mr. Wade seconded the motion.

CASE NO. 07-V086--GRANTED
Robert Teasley of Signs Inc., 6770 Veterans Parkway, to increase the area of a
sign from 250 square ft to 412 square ft. The property is zoned GC.
Mr. Teasley stated that this is the Lowe?s location and they need to add to the
length of the panel to advertise for a new tenant.
There was no opposition present to this appeal.
Mr. Wade made a motion to grant this appeal. Mr. King seconded the motion.
Motion carried unanimously.
CASE NO. 07-V087--WITHDRAWN
Appeal request of Archer Properties, LLLP, for a variance to reduce the
required length of parking stalls from 20 ft to 18 ft pending replat. The
property is zoned GC.
CASE NO. 07-V088--GRANTED
Warren Mason of Moon, Meeks, Mason & Vinson, Inc., 7020 Moon Road, to increase
the required number of parking spaces from 36 to 178. The property is zoned RO.
Mr. Mason stated that the parking at the Hospice facility is very challenging
and the request is to ease the tension of parking due to the growing need at
the facility and the projected planning of construction.
There was no opposition present for this appeal.
Mr. Borom made a motion to grant this appeal. Mr. Wade seconded the motion.
Motion carried unanimously.
CASE NO. 07-V089--GRANTED
Warren Mason of Moon, Meeks, Mason & Vinson, Inc., 6084 Business Park Drive, to
increase the required number of parking spaces from 44 to 56. The property is
zoned GC.
Mr. Mason stated that there will be another 2-story facility on the property
that will need parking in the rear and the parking is being requested to meet
the new business parking needs.
There was no opposition present for this appeal.
Mr. King made a motion to grant this appeal. Mr. Lewis seconded the motion.
Motion carried unanimously.
CASE NO. 07-V090--GRANTED
Warren Mason of Moon, Meeks, Mason & Vinson, Inc., 6001 Miller Road, to
increase the required number of parking spaces from 12 to 20. The property is
zoned GC.
Mr. Mason stated the client is a tire dealership. Their hardship is parking
for their customers who have to leave their vehicles as well as their employee
parking.
There was no opposition present for this appeal.
Mr. King made a motion to grant this appeal. Mr. Borom seconded the motion.

CASE NO. 07-V091--GRANTED
Warren Mason of Moon, Meeks, Mason & Vinson, Inc., 711 Veterans Parkway, to
increase the required number of parking spaces from 10 to 16 pending replat.
The property is zoned GC.
Mr. Mason stated that this is a proposed bank that has requested the increase
in parking spaces.
There was no opposition present for this appeal.
Mr. Borom made a motion to grant this appeal. Mr. Wade seconded the motion.
Motion carried unanimously.
CASE NO. 07-V092--GRANTED
Warren Mason of Moon, Meeks, Mason & Vinson, Inc., 2521 Brookstone Centre
Parkway, to increase the required number of parking spaces from 26 to 38
pending replat. The property is zoned GC.
Mr. Mason stated that this is a CPA firm site that is requesting the increase
of parking spaces mainly for the increase of their clients during tax season.
There was no opposition present for this appeal.
Mr. King made a motion to grant this appeal. Mr. Lewis seconded the motion.
Motion carried unanimously.
There being no further business to come before the Board, the meeting adjourned
at 2:55 p.m.
