Subject Proposed Floyd Road Rezoning
Description Have the staff to determine if the City did work on a private
project with City machinery in relation to a detention pond around Floyd Court
and Acorn Street. (Request of Mayor Poydasheff)
Have the staff to go to Floyd Court and find out why there is continual
flooding in this particular area and determine what we can do to assist the
citizens who live on Floyd Court, Acorn Street, and Burke Street to alleviate
the water that continues to flood their property. (Request of Councilor

Response 9/15/2006 Rufus Riggs, Director of Public Services checked their
records and found no information where they may have worked on the private
property.
There have been 14 complaints recorded since 1988 on Floyd Court, 12 of those
from 4803 Floyd Court. Most of these referred to a need to clean the ditch and
a few in reference to an inlet being clogged. On July 14, 2006 Public Services
completed repair of an inlet and installed a 30 " grate on top of the inlet.
We did find record where there was a complaint of flooding after a heavy
rainfall on 9/14/1995 where two houses were flooded on Floyd Court, 4812 and
4808 during a grading operation. Apparently clearing started on April 10,
1995 without a permit. The work was halted on April 12 by Department of
Engineering. A permit was obtained on 4/13/1995 for clearing at Bread of Life
Christian Center. Another permit was issued to a Mr. Kittrell, New Life
Construction on 9/25/1995. A temporary sediment basin was installed prior to
the flooding date of September 14, 1995. Recommendations were made for
modification to the pond. Since this date no other calls have been registered
regarding flooding of residences. The church abandoned project to expand after
determining cost of construction.
09/15/06 DCM Arrington contacted Bishop L.D. Skinner, with Bread of Life
Ministries concerning work performed on the property in the past. Bishop
Skinner's recollection of the work performed in 1995 was consistent with the
permit records in Engineering. The work was performed by Mr. John Kittrell
with New Life Construction. At no time does Bishop Skinner recall work on the
church property being performed by City personnel.
There have been 6 complaints on White Oak Street since 2003 complaining of
standing water and depth of the ditch behind their house. Most of these were
found to be on private property.
There have been 6 complaints on Acorn Street varying from standing water, ditch
cleaning and sink hole around inlet.
