SUBJECT: Condemnation on Corporate Ridge/Woodruff Farm (Parcel 2)



INITIATED BY: Felton G. Grant, Right of Way Acquisition Coordinator,

Transportation Planning Division







Recommendation: Approval is requested for the acquisition of Parcel 2, Tax

Map# 097 045 002, Corporate Ridge Parkway (map attached) for the Intersection

Improvement of Corporate Ridge Parkway @ Woodruff Farm Road Project

No.PRC10-SO11-00 (685) totaling 0.023 +/- acres for Right of Way, 0.078 +/-

acres for Preeminent Construction Easement and 0.038 +/- acres for Temporary

Construction Easement for County Road and/or Municipal Street purposes, and

authorizing the filing of a Declaration of Taking by the City Attorney or his

representatives for the acquisition of said land under the authority of the

official code of Georgia annotated, Section 32-3-1 et.seq for the Corporate

Ridge @ Woodruff Farm Road Intersection SO11685, Project No.

PRC10-SO11-00(685), Muscogee County.



Background: The parcel is one of three parcels on this project and this

project is the 3rd of three projects that was involved in the agreement of the

previous Governor to assist in upgrading the traffic flow in the Corporate

Ridge area.



Analysis: To keep the project on schedule, it was determined by the Legal

Counsel of the Development Authority and the Legal Counsel of the City to

proceed with condemnation because of multiple entities with interest that would

be difficult to obtain releases within a reasonable time. It is necessary to

proceed to condemn and to pay the money into Court, thereby taking position of

the property allowing the City to proceed with the project.



Financial Considerations: This project is funded by the CIP Funds.



Projected Annual Fiscal Impact Statement: There will be no Projected Annual

Fiscal Impact, except for cost of Condemnation expense. Should not exceed

$5,000.00.



Legal Considerations: The City Attorney agrees to this action.



Recommendations/ Actions: Authorizing the City Manager to order the

Acquisition of said lands for County Road and/or Municipal Street purpose, and

authorizing the filing of a Declaration of Taking by the City Attorney or his

representatives for the acquisition of said land under authority of the

official code of Georgia annotated, Section 32-3-1 et-seq.

A RESOLUTION DECLARING THAT THERE IS A NEED AND NECESSITY TO IMMEDIATELY

ACQUIRE TITLE AND EASEMENTS TO LANDS UNDER THE PROVISION OF THE OFFICIAL CODE

OF GEORGIA ANNOTATED, AUTHORIZING THE MAYOR TO ORDER THE ACQUISITION OF SAID

LANDS FOR COUNTY ROAD AND/OR MUNICIPAL STREET PURPOSES, AND AUTHORIZING THE

FILING OF A DECLARATION OF TAKING BY THE CITY ATTORNEY OR HIS REPRESENTATIVES

FOR THE ACQUISITION OF SAID LANDS UNDER THE AUTHORITY OF THE OFFICIAL CODE OF

GEORGIA ANNOTATED, SECTION 32-3-1, ET. SEQ.





WHEREAS, it is hereby determined that the circumstances in connection

with acquiring rights-of-way for the Corporate Ridge Parkway at Woodruff Farm

Road (PRC10-S011-00(685)) are such that it is necessary to immediately acquire

the fee simple title and/or easements in the following described property,

to-wit:

as shown colored yellow on a plat filed in the Office of the Right of Way

Acquisition & Transportation Planning Coordinator of Columbus, Georgia.



Beginning at a point 58.43 feet left of and opposite Station 10+64.95 on the

construction centerline of CORPORATE RIDGE PARKWAY on Georgia Highway Project

No. PRC10-S011-00(685); running thence N 3o16'17" E a distance of 21.22 feet to

a point 73.47 feet left of and opposite station 10+49.98 on said construction

centerline laid out for CORPORATE RIDGE PARKWAY; thence N 48o15'38"E a distance

of 25.27 feet to a point 49.85 feet right of and opposite station 54+67.00 on

said construction centerline laid out for WOODRUFF FARM ROAD; thence S 5o32'12"

E a distance of 68.22 feet to a point 58.35 feet left of and opposite station

11+05.00 on said construction centerline laid out for CORPORATE RIDGE PARKWAY;

thence N 41o43'05" W a distance of 40.05 feet back to the point of beginning.

to a point 57.69 feet left of and opposite station 14+05.00 on said

construction centerline laid out for CORPORATE RIDGE PARKWAY; thence N

48o09'25" E a distance of 52.31 feet to a point 110.00 feet left of and

opposite station 14+05.00 on said construction centerline laid out for

CORPORATE RIDGE PARKWAY; thence S 41o50'35" E a distance of 39.00 feet to a

point 110.00 feet left of and opposite station 14+44.00 on said construction

centerline laid out for CORPORATE RIDGE PARKWAY; thence S 48o09'25" W a

point 49.90 feet right of and opposite station 57+81.57 on said construction

centerline laid out for WOODRUFF FARM RD.; thence northeasterly 120.163 feet

along the arc of a curve (said curve having a radius of 540.501 feet and a

chord distance of 119.916 feet on a bearing of N 42o02'01" E) to the point

51.07 feet right of and opposite station 58+90.79 on said construction

centerline laid out for WOODRUFF FARM RD.; thence S 21o17'07" W a distance of

46.16 feet to a point 64.00 feet right of and opposite station 58+51.00 on said

construction centerline laid out for WOODRUFF FARM RD.; thence S 42o41'28" W a

distance of 57.44 feet to a point 64.00 feet right of and opposite station

58+00.00 on said construction centerline laid out for WOODRUFF FARM RD.; thence

S 56o18'26" W a distance of 96.49 feet back to the point of beginning.



Containing 0.038 acres more or less.



Said latter temporary easement for the construction of slopes, only, will

expire upon completion and final acceptance of said project by the Columbus

Consolidated Government.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS

FOLLOWS:



1. That there is a necessity for the immediate acquisition of said

property and property interests under the provisions of the Official Code of

Georgia Annotated ?32-3-1, et. seq.



2. That the Mayor of Columbus, Georgia be, and she hereby is,

authorized to issue such orders and file such papers in the courts and enter

into such agreements as she deems necessary for the immediate acquisition of

said property and property interests by condemnation under the provisions of

said Act.



3. That the immediate acquisition of such property and property

interests is for county roads, municipal streets or public highway purposes.



4. That in accordance with an investigation and report made to

Columbus, Georgia by a competent land appraiser, the estimated value of

$1,310.00 is just and adequate compensation to be paid for such acquisitions,

and is hereby determined and approved, with such sum being authorized to be

paid into Court for the use of the persons entitled thereto.



5. That the Mayor, City Manager and City Attorney, or their

representatives, are hereby authorized to take any and all lawful actions that

they may deem needful, necessary, advisable, or proper for the immediate

acquisition of said property and property interests pursuant to and in

accordance with the provisions of the Official Code of Georgia Annotated

?32-3-1, et. seq.
