A RESOLUTION

WHEREAS, the Georgia State law governing scrap metal recyclers specifically
pre-empts consolidated governments from enacting any law regarding the sale or
purchase of scrap metals (O.C.G.A. Section 10-1-358);
WHEREAS, citizens of Columbus, Georgia continue to experience the constant
theft of copper from their homes, gutters, air-conditioners, churches,
businesses and building sites;
WHEREAS, the enactment of the Secondary Metal Recyclers Act has not been
sufficient to address this constant criminal activity and this Council desires
a further amendment to O.C.G.A. Section 10-1-358.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:
We hereby request that the local delegation to the Georgia General
Assembly introduce legislation amending O.C.G.A. Section 10-1-358 so that it
allows consolidated governments to enact local laws that are more restrictive
than the provisions of the Secondary Metal Recyclers Act contained at
O.C.G.A. Sections 10-1-350 et seq. Let a copy of this resolution be forwarded
by the Clerk of Council to each member of the local delegation to the Georgia
General Assembly.
