SUBJECT: Joint Access and Utility Easement
INITIATED BY: David Arrington, Deputy City Manager
Recommendation: Approval is requested to execute a Joint Access Easement
between Foundation Properties, the Consolidated Government and W.C. Bradley
Company to promote development by permitting the construction of a pedestrian
bridge between property located at #13 11th Street and the City parking deck
located in the 1000 block of Front Avenue.
Background: In 2004, the City entered into a Memorandum of Understanding with
Foundation Properties and W.C. Bradley Company to develop a 523 space parking
deck on Front Avenue to provide parking for student housing, employees of W.C.
Bradley Company and the public. Under the partnership agreement Foundation
Properties is allocated 299 spaces on the 3rd, 4th, and 5th floor for student
parking, W.C. Bradley is allocated 118 spaces on the 2nd floor for employee
parking and the City is allocated 106 spaces on the ground floor for public
parking. The public parking on the ground floor is free to the public. Under
the terms of the MOU the City entered into a lease agreement with Foundation
Properties and W.C. Bradley for parking, which the proceeds of which pays for
the debt service on the bond issue to construct the garage.
Analysis: W.C. Bradley Company is redeveloping property located at #13 11th
Street as residential property to serve as student housing for Columbus State
University students. As student housing, residents require access to the
parking spaces allocated for student parking in the Front Avenue deck. The
construction of a pedestrian bridge from the redeveloped property to the
parking deck will provide direct access for students to their assigned parking
area. Maintenance responsibility for the pedestrian bridge will be the
responsibility of W.C. Bradley. The construction of the pedestrian bridge
requires an access and air rights easement from the City to provide the
connection from the redeveloped property to the designated student parking
area. The Joint Access Easement also includes conditions exclusively between
Foundation Properties and W.C. Bradley Company.
Financial Considerations: The City will not incur any financial liability by
granting this easement.
Projected Annual Fiscal Impact Statement: There is no annual financial impact
as a result of the easement.
Legal Considerations: Council approval is required for easements.
Recommendations/ Actions: Authorize the City Manager to execute a Joint Access
and Utility Easement between Foundation Properties, Consolidated Government and
W.C. Bradley Co. to promote development by permitting the construction of a
pedestrian bridge between property located at #13 11th Street and the City
parking deck located in the 1000 block of Front Avenue.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A JOINT ACCESS EASEMENT
BETWEEN FOUNDATION PROPERTIES, THE CONSOLIDATED GOVERNMENT AND W.C. BRADLEY CO.
TO PROMOTE DEVELOPMENT BY PERMITTING CONSTRUCTION OF A PEDESTRIAN BRIDGE
BETWEEN PROPERTY LOCATED AT #13 11TH STREET AND THE CITY PARKING DECK LOCATED
IN THE 1100 BLOCK OF FRONT AVENUE.
WHEREAS, in 2004, the City entered into a Memorandum of Understanding with
Foundation Properties and W.C. Bradley Company to develop a 523 space parking
deck on Front Avenue to provide parking for student housing, employees of W.C.
Bradley Company and the public; and,
WHEREAS, W. C. Bradley Company is redeveloping property located at #13 - 11th
Street as residential property to address the increasing demand for student
housing at the Uptown Campus of Columbus State University; and,
WHEREAS, the redevelopment plan for the property provides for a direct
connection with a pedestrian bridge on the North side of the Front Avenue
parking deck between the residential property and the designated student
parking area; and
WHEREAS, it is necessary for W.C.Bradley Company to obtain an access and air
rights easement from Foundation Properties and the Consolidated Government in
order to proceed with construction of the pedestrian bridge.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to execute a Joint Access
Easement between Foundation Properties, Consolidated Government and W.C.
Bradley Co. to promote development by permitting the construction of a
pedestrian bridge between property located at #13 11th Street and the City
parking deck located in the 1000 Block of Front Avenue.
