SUBJECT: Abandonment of a Portion of Drainage and utility easement
located on the south property line of 1734 Laney Drive.
INITIATED BY: Donna Newman, Engineering Department
Recommendation: Approval is requested to execute a Quit Claim Deed to Lawrence
Stephens for abandonment of a seven (7) foot wide section along the northern
side of the existing ten (10) foot drainage and utility easement of Lot 43,
Block "N" Allison Estates Subdivision.
Background: Terry Langfitt, Builder for Lawrence Stephens, owner of Lot 43,
Block "N" Allison Estates Subdivision (1734 Laney Drive) submitted a request
for a building permit to the Inspection and Codes Department at which time he
found out that the structure his builder made application to have built fell
seven (7) feet onto a drainage and utility easement. All known utilities have
been contracted and agree to the abandonment of seven (7) feet of the existing
drainage and utility easement running easterly from the west property line
approximately 98.53 feet as shown on the highlighted plat.
Analysis: Terry Langfitt, builder for Lawrence Stephens, owner of Lot 43,
Block "N" Allison Estates Subdivision (1734 Laney Drive) submitted a request to
the Engineering Department requesting a portion of the existing Drainage and
Utility Easement be abandoned in order to construct a 24'x17' carport attached
to the existing house. After checking with the utility companies, it is in
agreement that a seven (7) foot wide section along the northern side of the
existing ten (10 ) foot drainage and utility easement running easterly from the
west property line approximately 98.53 feet can be abandon. The Engineering
Department has found no present or future use of that portion of the existing
easement. The remainders of all utility easements of record in effect and
providing appropriate width as required by the applicable utility companies
will be required for unknown utilities, repealing any conflicting ordinances,
and for other purposes.

Legal Considerations: The Council must approve the action by resolution.
Recommendations/ Actions: Authorizing the City Manager to execute a Quit Claim
Deed to Lawrence Stephens for abandonment of a seven (7) foot wide section
along the northern side of the existing ten (10) foot drainage and utility
easement of Lot 43, Block "N" Allison Estates Subdivision in order to construct
an attached 24' x 17' carport.

A RESOLUTION AUTHORIZING THE CITY MANAGER OF COLUMBUS, GEORGIA TO EXECUTE A
QUIT CLAIM DEED TO LAWRENCE STEPHENS FOR A PORTION OF THE EXISTING DRAINAGE AND
UTILITY EASEMENT AS SHOWN LOCATED AT 1734 LANEY DRIVE ON THE SURVEY ENTITLED
SURVEY OF LOT 14, BLOCK "N" SECTION NINE, ALLISON ESTATES LYING IN LAND LOT 43,
9TH DISTRICT.
WHEREAS, a seven (7) foot wide section along the northern edge of the existing
ten (10) foot drainage and utility easement of Lot 43, Block "N" Allison
Estates subdivision (1734 Laney Drive) was requested to be abandon in order to
construct a 24' x 17' attached carport.
WHEREAS, the aforementioned portion of the existing drainage and utility
easement is no longer in use and has been formally abandoned by all parties
concerned; and,
WHEREAS, Columbus, Georgia has no other use for the aforementioned portion of
the drainage and utility easement. The remainders of all drainage and utility
easements of record remain in effect and providing appropriate width as
required by the applicable utility companies will be required for unknown
utilities, repealing any conflicting ordinances, and for other purposes.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That, the City Manager is hereby authorized to execute a quit claim
deed to Lawrence Stephens for a seven (7) foot wide section along the northern
edge of the existing ten (10) foot drainage and utility easement of Lot 43,
Block "N" Allison Estates subdivision (1734 Laney Drive) in order to construct
a 24' x 17' attached carport.
