AN ORDINANCE

An Ordinance amending the Zoning Atlas of the Consolidated Government of

Columbus, Georgia; this amendment changes certain boundaries of a district

located on 3556 and 3562 St. Mary?s Road from SFR3 (Single Family Residential

3) District to GC (General Commercial) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the Department

of Community and Economic Development be, and the same is hereby amended by

changing the following described property from SFR3 (Single Family Residential

3) District to GC (General Commercial) District:



All that tract or parcel of land situate, lying and being in Land Lots Numbered

108 and 109 of the Coweta Reserve of Muscogee County, Georgia, the tract of

land hereby conveyed being particularly described as follows:



BEGINNING on the southwestern side of St. Mary's Road at an iron stake placed

442 feet northwest of an iron stake placed at the point where the south line of

said Land Lot 109 intersects the southwestern side of the St. Mary's Road (said

442 feet being measured along the southwestern side of St. Mary's Road);

running thence north 50 degrees 24 minutes west, along the southwestern side of

St. Mary's Road 105.3 feet, more or less, to an iron stake on the dividing line

between the land hereby conveyed and the land now or formerly of Simons; thence

south 2 degrees 10 minutes east, along the line dividing the land hereby

conveyed from the land now or formerly of Simons, 425 feet, more or less, to an

iron stake; thence north 87 degrees 50 minutes east 65 feet, more or less, to

an iron stake; thence northerly in a straight line 355 feet, more or less, to

the point of beginning.



The property above described is a portion of that tract conveyed to Annie

Lizzie Nicholson by J. C. McBride by deed dated May 6,1926 and recorded in Deed

Book 65, Folio 365, in the office of the Clerk of Superior Court of Muscogee

County, Georgia. Said property is shown as "Carl Dawson Nicholson" upon a map

or plat entitled "Survey of Part of the Nicholson Property, Lying in Land Lots

108 & 109, Coweta Reserve, Muscogee County, Georgia," prepared by Abram Siegel,

dated October 3, 1946 and recorded in Plat Book 3, page 254, in the aforesaid

Clerk's office.



And



All that tract or parcel of land situate, lying and being in Land Lots Numbered

108 and 109 of the Coweta Reserve of Muscogee County, Georgia, the land hereby

conveyed fronting 209.72 feet on the southwestern side of St. Mary's Road and

being particularly described as follows:



BEGINNING on the southwestern side of St. Mary's Road at an iron stake placed

902.79 feet (measured along said side of St. Mary's Road) northwest of the

intersection of the southwestern side of St. Mary's Road with the northwestern

side of Nightingale Drive; running thence south 04 degrees 48 minutes west,

along the western line of property conveyed by Carl Dawson Nicholson to Maury

A. Klumok, by deed dated January 15, 1964 and recorded in Deed Book 932, Folio

458, of the deed records of Muscogee County, Georgia, 318.7 feet to an iron

stake; thence south 87 degrees 45 minutes west, along the northern line of said

property conveyed to Maury A. Klumok, 199.52 feet to an iron stake; thence

north 02 degrees 10 minutes west 99.93 feet to an iron stake placed at the

southwestern corner of that tract of land conveyed by Annie Lizzie Nicholson to

Carl Dawson Nicholson by deed dated October 26, 1946 and recorded in Deed Book

247, Folio 87, of said deed records; thence north 87 degrees 50 minutes east,

along the south line of said property conveyed by Annie Lizzie Nicholson to

Carl Dawson Nicholson, 65 feet to an iron stake; thence north 00 degrees 01

minute east, along the east line of said property conveyed by Annie Lizzie

Nicholson to Carl Dawson Nicholson, 353.47 feet to an iron stake placed on the

southwestern side of St. Mary's Road; thence southeasterly, along the

southwestern side of St. Mary's Road, 209.72 feet to the point of beginning.



The tract of land hereby conveyed contains 1.50 acres, more or less, and is all

of the property conveyed by Carl Dawson Nicholson, as Executor of the Will of

Annie Lizzie Nicholson, deceased, to Carl Dawson Nicholson, individually, by

deed dated August 19, 1958, recorded in Deed Book 664, Folio 226, of the

aforesaid deed records, LESS AND EXCEPT the approximate 8.85-acre tract

conveyed by Carl Dawson Nicholson to Maury A. Klumok by warranty deed dated

January 15, 1964 and recorded in Deed Book 932, Folio 458, of the aforesaid

deed records. The property hereby conveyed is shown as "1.50 Ac." on a plat

entitled "Survey of Part of Property of Annie B. Nicholson Estate, Part of Land

Lots 108 & 109, Coweta Reserve, Muscogee County, Georgia," prepared by Siegel

Engineering Company, dated August 21, 1957, revised December 3, 1985 and

recorded in Plat Book 32, Folio 39, in the office of the Clerk of Superior

Court of Muscogee County, Georgia.



The above-described property is being rezoned with the following conditions:



1. The site plan developed by Ray Underwood, Architect, dated

May 12, 2006 is hereby incorporated by reference and made a part of this

ordinance.



2. The property subject to rezoning shall be limited to

office and mini-storage use only.

held on the 17th day of July, 2007; introduced a second time at a regular
