BOARD OF ZONING APPEALS
REGULAR MEETING - 2:00 P.M. ? SEPTEMBER 5, 2007
The Regular Meeting of the Board of Zoning Appeals was held Wednesday,
September 5, 2007 at 2:00 P.M., on the 1st Floor of the Government Center Annex
in the conference room, 420-10th Street. Mr. Billy Edwards, Board Chairman,
called the meeting to order. The board members present were:
Mr. Perry Borom
Mr. Wright Wade
Mr. Willie Lewis, Jr.
Also present representing the Inspections and Code Enforcement Department was
Mr. Danny Cargill, Secretary of the Board, and Mrs. Millicent Burden, Recording
Secretary.
CASE NO. 07-V071--GRANTED
Doug McCullar, 4001 Wooldridge Road, to reduce the rear yard setback
requirement from 50 ft to 30 ft for an accessory structure. The property is
zoned RE1.
Mr. McCullar stated that if he moves the building forward that he would be in a
bad contour towards the lake and would like to leave a natural buffer. He will
do all that he can to make the building blend in with the rest of the property
and the house that he is building. He spoke with the neighbors and they had no
objection. The water runoff will be going to a drainage ditch toward the lake.
There was no opposition present for this appeal.
Mr. Wade made a motion to grant this appeal stating that where the owner is
placing the building is actually the best place to put it. Mr. Borom seconded
the motion. Motion carried unanimously.
CASE NO. 07-V072--GRANTED
C. L. Pierson III, 529 Rudgate Road, to allow an accessory structure in the
side yard; to reduce the side yard setback requirement from 5 ft to 4 ft; to
increase the height requirement from 14 ft to 22 ft 6 in. The property is
zoned SFR2.
Mr. Pierson stated that the garage would line up to an existing driveway and
match the existing house and elevation so that the rooflines will match. The
water will run off through the sideline. He spoke with his neighbors and they
do not object.
There was no opposition present for this appeal.
Mr. Borom made a motion to grant this appeal stating that the roofline and the
materials will match the existing house and there was no opposition. Mr. Wade
seconded the motion. Motion carried unanimously.
CASE NO. 07-V073--GRANTED
Al Picken of Premier Homes, 6141 Brookstone Boulevard, to increase the height
of an accessory structure from 14 ft to 25 ft 2 in. The property is zoned
SFR2.
Mr. Picken stated that the house was destroyed from the storm that hit earlier
this year and the accessory structure will be built to match the existing
house. He also stated that gutters would also be installed.
There was no opposition present for this appeal.
Mr. Lewis made a motion to grant the appeal based on the statement from the
contractor. Mr. Borom seconded the motion. Motion carried unanimously.
CASE NO. 07-V074--DENIED
Ray Phillips of Ray Phillips Siding Inc., 10530 Whitesville Road, to reduce the
side yard setback requirement from 25 ft to 10; to reduce the rear yard setback
requirement from 50 ft to 16 ft for an accessory structure. The property is
zoned RE1.
Mr. Phillips stated that his client wanted to put in a double carport and there
is not enough room. He also stated that if this request is not approved he
would place it on the other side.
Mr. Larry Love was present in opposition to the request. He stated that there
are more than three buildings on the property and it is an eyesore to the area.
Mr. Borom made a motion to deny this appeal stating that none of the neighbors
approve of it and there is not a hardship present. Mr. Wade seconded the
motion. Motion carried unanimously.
CASE NO. 07-V075--GRANTED
Stefon Newsome of Action Buildings and Don Johnston, owner, 2900 Veterans
Parkway, to reduce the side corner setback requirement from 20 ft to 3 ft; to
reduce the rear corner setback requirement from 20 ft to 2 ft for an accessory
structure. The property is zoned GC.
Mr. Newsome stated that the hardship is that the lot is surrounded by roadway
on three sides. The accessory structure that they are adding will not come up
to the road at all. The building is needed for storage for his hot dog
business.
Mr. Cargill stated that because of the distance of the property lines, the
building code will require that the building be fire rated.
There was no opposition present for this appeal.
Mr. Wade made a motion to grant this appeal stating that the building will be
fire rated. Mr. Borom seconded the motion. Motion carried unanimously.
CASE NO. 07-V076?GRANTED w/stipulations
Rickey Biggers of Rickey Biggers Construction, 3630 Vivian Lane, to reduce the
side yard setback requirement from 8 ft to 3 ft for an addition. The property
is zoned SFR2.
Mr. Biggers stated that the lot is at an angle and is not giving him the room
he needs for the addition. The roof pitch will be hipped. The water will
runoff to the owner?s back yard and the materials will match the existing house.
Mr. Edwards asked if he would be opposed to adding gutters. Mr. Biggers stated
that he had no problem adding gutters.
There was no opposition present for this appeal
Mr. Borom made a motion to grant this request stating that the roof pitch
matches the existing house and there was no opposition and adding the
stipulation that gutters will be added. Mr. Lewis seconded the motion. Motion
carried unanimously.
CASE NO. 07-V077--GRANTED
Dale Smith of Ray M. Wright Inc., 8037 Garrett Pines Drive, to reduce the side
yard setback requirement from 8 ft to 6 ft 6 in to erect a single-family
residence. The property is zoned SFR3.
Mr. Smith stated that he actually has a building permit for this location
already that shows the house should fit on the lot, but during construction, he
learned the house does not fit. He wants to push the front of the house back a
little further so it would be in line with the rest of the house.
There was no opposition present to this appeal.
Mr. Borom made a motion to grant this appeal stating that it would be in
uniformity with the existing subdivision. Mr. Wade seconded the motion.
Motion carried unanimously.
CASE NO. 07-V078--GRANTED
Dale Smith of Ray M. Wright Inc., 1552 Tom Buk-Tu Lane, to reduce the rear yard
setback requirement from 30 ft to 22 ft to erect a single-family residence.
The property is zoned SFR2.
Mr. Smith stated that this lot has an unusual shape. There is a gentleman that
is adamant about having that particular lot and a particular plan. The lot is
not very deep.
There was a letter submitted to the board by an adjacent property owner in
opposition. The board acknowledged the letter and a copy of the letter is on
file.
Mr. Wade made a motion to grant this appeal stating that hardship was valid.
Mr. Borom seconded the motion. Motion carried unanimously.
CASE NO. 07-V079--GRANTED
Ray Peters of AAA Sign Co. Inc. and Jeff Jordan of Circle K stores, 5758 Milgen
Road, to alter an existing non-conforming billboard. The property is zoned GC.
Mr. Peters stated that they are requesting the add LED to the sign primarily
for safety. The employees actually have to physically climb up and change the
prices and it is a safety hazard as well as a insurance issue.
There was no other opposition presented for this appeal.
Mr. Wade made a motion to grant the request stating that the graphics were the
only thing changing and the concern was the safety of their employees. Mr.
Lewis seconded the motion. Motion carried unanimously.
Mr. Borom made a motion to excuse Mr. King from the monthly meeting due to
personal business. Mr. Wade seconded the motion. Motion carried unanimously.
Mr. Wade made a motion to accept the minutes as written from the August
meeting. Mr. Borom seconded the motion. Motion carried unanimously.
There being no further business to come before the Board, the meeting adjourned
at 3:18 p.m.
