SUBJECT: Timber Creek Estates -Joint Use Access Easement
INITIATED BY: Engineering Department
Recommendation: Approval is requested to access Heiferhorn Way by means
of an access easement for Timber Creek Estate subdivision.
Background: The Traffic Engineering Division received a site plan that
indicated a need to request a variance to the City Code requirements. The City
Code Section 7.9.2 prohibits direct driveway access to Whitesville Road an
arterial roadway. Also, City Code Section 7.4.2 prohibits access easements to
residential lots.
Analysis: The four residential lots can be served by a single driveway access
to Heiferhorn Way being a much safer condition than access to Whitesville
Road. The Traffic Engineering Division reviewed the site plan and recommends
approval of the variance. A Joint Use Access Easement will need to be prepared
and recorded for this purpose.
Financial Considerations: A denial would prevent the installation of the
driveway.
Projected Annual Fiscal Impact Statement: There are no costs to the City beyond
administrative cost for permitting and inspections.
Legal Considerations: A variance to the City Code requirements for the access
easement requires Council approval.
Recommendations/ Actions: Approve the recommended variance for the driveway
access to Heiferhorn Way for Timber Creek Estates subdivision.

A RESOLUTION AUTHORIZING A VARIANCE TO CITY CODE SECTION 7.4.2 TO ALLOW FOR A
PRIVATE JOINT USE ACCESS EASEMENT TO TIMBER CREEK ESTATES SUBDIVISION FROM
HEIFERHORN WAY.
WHEREAS, City Code Section 7.4.2 prohibits access easements to residential
subdivisions; and,
WHEREAS, City Code Section 7.9.2 prohibits the direct driveway access to an
arterial or connector such as Whitesville Road by residential lots; and,
WHEREAS, the property developer submitted a plat of Timber Creek Estates for
lots 72, 73, 74 and 75 along Whitesville Road to provide for a single driveway
access to Heiferhorn Way, a Local street, using a Joint Use Access Easement;
and,
WHEREAS, the Traffic Engineering Division investigated the request and
recommends that a variance be approved.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
THAT TIMBER CREEK ESTATES IS HEREBY GRANTED A VARIANCE TO CITY CODE
SECTION 7.4.2 TO ALLOW A JOINT USE ACCESS EASEMENT TO SERVE LOTS 72, 73, 74 AND
75 FOR DRIVEWAY ACCESS TO HEIFERHORN WAY.
