SUBJECT: Milgen Road McDonald's - Encroachment on Right-of-way
INITIATED BY: Engineering
Recommendation: Council to consider approving a permanent Encroachment on the
Lakeshore Drive cul-de-sac right-of-way. The Milgen Road McDonald's restaurant
requested authorization to construct a portion of a new Drive-thru lane on the
cul-de-sac right-of-way a distance of five (5) feet.
Background: The Milgen Road McDonald's restaurant plans to provide certain
renovations to this property. Part of the renovations includes constructing a
second Drive-thru around the east end of the building. As noted by the
attached drawing, the second Drive-thru relocates the Pass-by lane causing it
to encroach into the City street right-of-way of Lakeshore Drive at the dead
end cul-de-sac. The Unified Development Ordinance requires that all
Drive-thru/Pass-by lanes be constructed on private property and not encroach
into street rights-of-way. The cul-de-sac has only ten (10) feet of
right-of-way between the face of the street curb and the right-of-way/property
line.
Analysis: Since the existing Pass-by lane is being moved away from the
building toward the cul-de-sac, there appears to be sufficient area on the
McDonald's property to construct both the Drive-thru and Pass-by lanes without
encroaching onto the Lakeshore Drive cul-de-sac right-of-way. See attached

Financial Considerations: There are not any direct cost to the City beyond
losing the use of this public right-of-way.
Legal Considerations: Since the City Code requires that all improvements be
accomplished on private property, a permanent encroachment onto public
right-of-way requires Council approval.
Recommendations/ Actions: Council to consider approving a permanent
Encroachment on the Lakeshore Drive cul-de-sac right-of-way for a Drive-thru
lane for the Milgen Road McDonald's restaurant.

A RESOLUTION AUTHORIZING THE MCDONALDS RESTAURANT LOCATED AT 5628 MILGEN ROAD
TO ENCROACH A PASS-BY LANE ONTO THE RIGHT-OF-WAY OF THE CUL-DE-SAC OF LAKESHORE
ROAD A DISTANCE NOT TO EXCEED FIVE (5) FEET IN ACCORDANCE TO SITE DEVELOPMENT
PLANS APPROVED BY THE DEPARTMENT OF ENGINEERING.
WHEREAS, the Milgen Road McDonalds restaurant is making renovations to the
building and parking lots to include the addition of a second Drive-thru lane;
and,
WHEREAS, these improvements are relocating the existing Pass-by lane that
allows vehicles to circulate around Drive-thru vehicles; and,
WHEREAS, McDonalds requests allowing five (5) feet of the new Pass-by lane to
encroach into the Lakeshore Road cul-de-sac right-of-way which is prohibited by
City Code.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO ALLOW THE MCDONALDS
RESTAURANT LOCATED AT 5628 MILGEN ROAD TO ENCROACH A PASS-BY LANE ONTO THE
RIGHT-OF-WAY OF THE CUL-DE-SAC OF LAKESHORE ROAD A DISTANCE NOT TO EXCEED FIVE
(5) FEET IN ACCORDANCE TO SITE DEVELOPMENT PLANS APPROVED BY THE DEPARTMENT OF
ENGINEERING VIA ENCROACHMENT PERMIT.
