SUBJECT: Easement For Columbus Water Works

Recommendation: Approval is requested to grant an easement to Columbus Water

Works on property located over and through the right of way of Part of Land Lot

59 8th District (55D Chive Court) in Columbus, Muscogee County, Georgia. (See

Easement and Attachment Exhibit ?A?.)



Background: George C. Woodruff Co. conveyed to Columbus, Georgia on July 7,

2002, 0.897 acres +/- of a Detention Basin shown on a map or plat entitled

?Section Four PEPPERTREE II Lying in Land Lots 42, 43, 58 & 59, 8th District?.

Columbus Water Works would like to use Part of Land Lot 59, 8th District to

construct and maintain water mains on said strip of land marked in yellow on

attach ?Water Easement?. This will allow accessing said strip of land to

construct the water mains, and for inspecting and maintaining the same in good

serviceable condition. Columbus Water Works shall have the right to cut and

remove any trees or vegetation that may interfere with the construction and

maintenance.



Analysis: Columbus Water Works shall be solely responsible for all costs

related to any construction, maintenance activities or maintaining the

landscaping it undertakes related to the Easement at no cost to the City. The

easement will not interfere with the current use of the property. The easement

would be granted with conditions as provided on the attachment.



Financial Considerations: Columbus Water Works is solely responsible for all

costs.



Legal Considerations: The granting of an easement on City property requires the

approval of Council.



Recommendations/ Actions: Approve the Resolution authorizing the City Manager

to grant an easement to Columbus Water Works on property located over and

through the right of way of Part of Land Lot 59 8th District in Columbus,

Muscogee County, Georgia.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO GRANT AN EASEMENT TO THE COLUMBUS

WATER WORKS ON PROPERTY LOCATED OVER AND THROUGH THE RIGHT OF WAY OF PART OF

LAND LOT 59 8TH DISTRICT, 55D CHIVE COURT, IN COLUMBUS, MUSCOGEE COUNTY,

GEORGIA.





WHEREAS, the George C. Woodruff Co. conveyed to Columbus, Georgia 0.897 acres

+/- of a Detention Basin shown on a map or plat entitled ?Section Four

PEPPERTREE II Lying in Land Lots 42, 43, 58 & 59, 8th District?; and,



WHEREAS, the easement will be granted for the purpose of use, access,

constructing and maintaining water mains over a portion of Part of Land Lot 59

8th District at no cost to the City; and,



WHEREAS, granting of an easement will not interfere with the current

use of the property.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:



That the City Manager is hereby authorized to grant an easement for use, access

and constructing and maintaining water mains to Columbus Water Works on City

property located over and through the right of way of Part of Land Lot 59 8th

District 0.897 acres +/- in Columbus, Muscogee County, Georgia.
