AN ORDINANCE
NO.
An Ordinance amending the Zoning Atlas of the Consolidated Government
of Columbus, Georgia; this amendment changes certain boundaries of a district
located at 6801 and 6923 River Road from NC (Neighborhood Commercial) District
to PCD (Planned Commercial Development) District.
THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:
That the Zoning Atlas on file with the Planning Division of the
Department of Community and Economic Development be, and the same is hereby
amended by changing the following described property NC (Neighborhood
Commercial) District to PCD (Planned Commercial Development) District:
All that lot, tract or parcel of land situate, lying and being in Muscogee
County, Georgia and being known and designated as all of Parcel 100, containing
12.45 acres, as said Parcel 100 is more particularly described on that certain
map or plat entitled ?Replat of Part of the Village of Green Island, Lying in
Land Lots 83 & 95, 8th District, Columbus, Muscogee County, Georgia?, dated
December 5, 2008, prepared by Moon, Meeks, Mason & Vinson, Inc., recorded in
Plat Book 161, Folio 317, of the records in the Office of the Clerk of Superior
Court of Muscogee County, Georgia, to which reference is made for a more
complete and accurate description of the property herein conveyed.
This conveyance is hereby made subject to any and all zoning ordinances,
restrictions, easements and restrictive covenants of record or in actual
existence upon the above described property.
The above-described property is being rezoned with the following conditions:
(1) North End, LLC shall follow the schematic master plan dated December
10, 2008 (hereinafter, the ?schematic master plan?), with only those changes
allowed under and approved in accordance with the UDO.
(2) Total square footage of all buildings in the development shall be limited
to 122,000 sq. ft. and no building footprint shall exceed 11,500 sq. ft. as
shown on the schematic master plan with only such changes thereto as are
allowed under and approved in accordance with the UDO.
(3) Only 50% of the space in the development shall be used for retail (in other
words, no more than 61,000 sq. ft. of space can be used for retail).
(4) No business shall be allowed to open for business more than 20 hours a day.
(5) North End, LLC shall have the option to use space not used as retail for
either office or residential purposes.
(6) Any restaurant or retail user shall be allowed up to 20,000 sq. ft. of
space, subject to the building footprint limitation set forth in Condition 2
above. A professional, medical or dental office user shall have no limit on
the maximum amount of space in a single building, but in all other respects
shall satisfy and comply with the conditions in this rezoning.
(7) No building in the development within 150 feet of Green Island Drive
(subject to the buffer to be provided along Green Island Drive as shown on the
schematic master plan) shall exceed 1 and 1/2 stories above ground in height.
No building more than 150 feet from Green Island Drive and south of the
?service area? as shown on the schematic master plan shall exceed 2 stories
above ground in height. No building more than 150 feet from Green Island Drive
and north of the ?service area? as shown on the schematic master plan shall
exceed 4 stories above ground in height.
(8) All square footage shall be based upon heated and cooled space.
(9) North End, LLC shall maintain strict architectural
control to match the existing buildings already located at River Road
and the north side of Mountainbrook Drive.
(10) North End, LLC shall not be required to meet the
buffer required by the UDO on the north or south side of the
development, or the required parking of the UDO, but shall comply
with the schematic master plan which provides additional buffers
on the rear side of the development (along Green Island Drive) and
for more green space than required under the UDO.
(11) The schematic master plan parking and parking required by the UDO may be
reduced with approval by the City Traffic Engineer based on actual use.
(12) Only monument signs shall be allowed at the entrances to the development
on River Road and Mountainbrook Drive. No pole signs or billboards shall be
allowed on or in the development.
(13) No entrance or other vehicular access to the development shall be
permitted along Green Island Drive.
(14) All garbage containers and receptacle facilities shall be screened from
adjacent properties by means of masonry structures or densely planted evergreen
landscaping as approved by the City Arborist. No such containers or facilities
shall be located in any buffer area or otherwise along Green Island Drive.
(15) Garbage pickup shall be done only on Mondays through Fridays and shall not
occur before 8:00 a.m. or after 8:00 p.m.
(16) All development lighting shall be directed internally.
(17) No fence shall be installed around any detention pond or basin.
(18) No bar, restaurant or other business shall be allowed to have dancing or
music, live or amplified, after midnight. No nude dancing, partial or total as
defined in Chapter 3 of the Columbus Code, shall be permitted and no adult
entertainment establishment shall be permitted on the property subject to
rezoning.
(19) North End, LLC and any owner(s) of the office bungalows shall install and
maintain landscaping to screen the office bungalows from residences across
Green Island Drive as specified by the City Arborist.
(20) No traffic study shall be required because the rezoning is a reduction in
the amount of square footage, and retail use is allowed under current zoning.
Applicant agrees to do a traffic impact study after the completion of 25,000
square feet in phase one if the planning department or engineering department
requests a study as authorized in section 7.94 (b) of the UDO.
