An Ordinance amending the Zoning Atlas of the Consolidated Government of

Columbus, Georgia; this amendment changes certain boundaries of a district

located at 3201 Macon Road from NC (Neighborhood Commercial) to GC (General

Commercial) zoning district.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Department be, and the same is

hereby amended by 35.095 acres of the following described property from NC

(Neighborhood Commercial) to GC (General Commercial) zoning district:



Tract One: (PARCEL ONE (A) [35 ACRES])



All that lot, tract or parcel of land situate, lying and being in Land Lots 94

and 95, Coweta Reserve, Columbus, Muscogee County, Georgia and being designated

as "Parcel A-35.54 Acres" on a survey entitled "ALTA/ACSM Land Title Survey for

Fidelity National Title Insurance Company of New York, Protective Life

Insurance Company, Glenwood Cross Country Company, L.L.C. of Cross Country

Plaza Shopping Center, lying in Land Lots 94 & 95 of the Coweta Reserve,

Columbus, Muscogee County, Georgia", prepared by Timothy W. Simpson, under date

of September 19, 2003 and revised through March 30, 2004 and being particularly

described within the following metes and bounds, to wit: To arrive at the point

of beginning of the property hereby conveyed, commence at the point which marks

the intersection of the east margin of the 60-foot wide right-of-way of Auburn

Avenue and the south margin of the 60-foot wide right-of-way of Birchfield

Drive and from said point running thence South 02? 47'46" West along the east

margin of Auburn Avenue a distance of 160.18 feet to the one-half inch rebar

and cap (hereinafter, "iron pin") which marks the point of beginning of the

Tract Two: (PARCEL TWO (C) [0.95 ACRES])



All that lot, tract or parcel of land situate, lying and being in Columbus,

Muscogee County, Georgia, being known and designated as 'Parcel C (0.95 Acres)'

as shown upon a map or plat entitled "Plat of Parcel C of Cross Country Office,

L.L.C. Shopping Center, Lying in Land Lots 94 & 95 of the Coweta Reserve,

Columbus, Muscogee County, Georgia", prepared by Timothy W. Simpson, Surveyor,

under date of March 31, 2004, filed for record April 8, 2004 and recorded in

Plat Book 151, Folio 8 in the Office of the Clerk of the Superior Court of

Muscogee County, Georgia, to which reference is made for a more particular

description of said property.



TOGETHER WITH a 25-foot access easement and appurtenant rights, including,

without limitation, free access across the westerly 90 feet of the boundary

line of the property conveyed by deed, all as contained in the deed from

Wellington Plaza, Inc. to Standard Oil Company, dated January 10, 1966 and

recorded in Deed Book 1049, page 274, in said Clerk's Office. (Tract One).



TOGETHER WITH those easement rights arising under that certain Limited Warranty

Deed from Cross Country Corporation, a Georgia corporation to Columbus Motel

Corporation, a Georgia corporation, dated September 25, 1978, filed for record

October 2, 1978, and recorded in Deed Book 1768, page 348 in the Office of the

Clerk of the Superior Court of Muscogee County, Georgia. (Tracts One and Two

excluding Parking)



The above-described property is being rezoned with the following conditions:



1) The following uses shall be prohibited: taxidermy, tattoo

parlors, transient lodging, homeless shelters, pawn shops, personal

care homes, private kennels, mobile home sales, and bus stations.

10th day of November, 2009; introduced a second time at a regular meeting of
