Councilor Pugh asked that I look into a situation related to a call she
received about MCP hiring policy. The caller suggested that we were "changing
a hiring list while there are Sergeant positions open". This in not correct.
Pursuant to our current and our proposed future ordinance, the hiring for
Sergeants and Lieutenants are to come from a list of internal candidates.
Those lists are good for 18 months. When Warden Hamrick came into his role as
an Interim Warden there was one opening for a Sergeant position. That position
was filled from the active list at the time. There have not been, and is not
now, an open Sergeant position at the Prison.
When Lt. Lynn was terminated on February 21, 20112 through the prolonged
process we are all familiar with that Lieutenant position became available, but
Lt. Lynn had a 30 day appeal period to appeal to Superior Court and that
expired on March 21, 2012. Also, neither the Warden, nor I, nor our legal
counsel felt comfortable filling that position until the investigation and
discipline of other MCP employees was completed. Two MCP employees were
disciplined last week and one will be disciplined this week thereby closing out
the DOC and CCG investigation of the MCP.
The 18 month period on the prior list expired March 30, 2012, by virtue of
existing local law. Again, there were no open Sergeant position on or before
March 30th and the only open Lieutenant position was that of Lt. Lynn, which
was not vacated until February 21st, and had a 30 day appeal period, which
expired on or about March 22nd (eight days prior to the list expiring).
Going forward under current ordinance (and the proposed new ordinance), a new
list will be created for hiring Sergeants and Lieutenants and it will be in
effect for an 18 month period.
The Warden and I will make sure that the MCP staff understands this
long-standing policy of MCP. I hope this clears up any questions from calls
you may have gotten.
