Subject Proposed Rezoning on Armour Road



Description Have the staff to look into those concerns of Mr. Gene Lewis as it

relates to the tractor-trailers blocking the road on Armour Road, waiting for

the gates to open to go into the trucking company on Armour Road. (Request of

Mayor Poydasheff)



Have the traffic engineer to provide a report as to the situation with the

traffic and trucks on Armour Road and determine if there is any way that we can

alleviate some of these problems. (Request of Councilor Davis)



Also, have the staff to address those concerns of Mr. Jackie Forehand as it

relates to water that goes through a retention/detention pond that eventually

ends up in a pond that is located in Mr. Forehand?s yard. Let?s see what we

can do about the trash that is being thrown onto the City?s right-of-way that

is piled up in that area. Also, look at putting up a privacy fence. (Request of

Councilor Davis)



Also have the staff to address the issue with Sam?s/Wal-Mart loading and

unloading at certain hours of the night. Let?s talk with Sam?s/Wal-Mart and see

if we can work something out as far as the loading/unloading at these stores.

Response Jun 1, 06 - I have researched the following information - Ron Hamlett

> Rezoning Ordinances 88-006 (Sams/Wal-Mart) & 98-112 (Mike Clark) do not have

any truck restrictions.

> All of the property along Armour Rd from Airport Thwy to Sowega Dr is zoned

commercial & consequently, are not subject to any truck restrictions as those

applicable to Residential Districts.

> I emailed a request to Mark Oropez, Airport Manager, asking the question if

the Airport Authority will consider installing a fence along the west side of

the roadway next to Sam's/Wal-mart to catch trash. Mark is on vacation this

week.

> Truck traffic to the existing warehouse is currently allowed & can not be

prohibited since state law guarantees that they are able to travel to their

place of business. This part of Armour Rd, Sowega Dr & the unnamed roadway

next to Sam's/Wal-mart have the same right of access.

> Existing No Parking Anytime - Ord. 90-041: No Parking Anytime along west

curb of Armour Rd beginning at the 500' south of the south curb of Alma St &

running north a distance of 525'. Should residents want No Parking along the

east curb, then, a new No Parking Anytime ordinance would have to be approved

by Council.



June 2-Donna Newman Visited site today. There is considerable trash along

private road. Will work with Airport Authority to get cleaned up. Will make

contact next week. Detention pond on park site is stable with a good

vegetative cover established to filter sand, etc. There were several slope

failures from the private property adjacent to the individuals.



June 9- Harvey Milner visited the site and spoke with Mr. Jackie Foran

concerning the lake on his property. From our understanding, the drainage

system was approved in the development with Mr. Foran concurrence. The lake is

private therefore, we perform no maintenance. Rufus.
